Hello,

I am an au pair on a J1 visa who has been in the US for more than a year. I am not subjected to the 2 year home residency requirement.

I married my boyfriend of three years last week and we are now filling out the paperwork for AOS.

Since my employment contract runs out next month, I decided to keep working for my host family who have been very nice and helpful.

I have a question about whether or not I should specify my actual occupation in form G325a since I shouldn't be working until I get my work authorization?

Yes. They will know anyway, and lying can get your case denied. Don't lie on these forms.

Yes. They will know anyway, and lying can get your case denied. Don't lie on these forms.

What about if I was an Au Pair for 2 years then August last year I got married to a US citizen but I didn't fill for AOS yet. But I decided to keep working as a nanny to help out my husband but I didn't get any takes taken from me! They used to pay me in cash! So now I am in a new job but the mom just let me know that they do nanny taxes! Should I do it? Or should I just quit? I'm just afraid to be risking to much!

Tax evasion is a felony. You need to file those back taxes. Illegal work is forgiven for spouses of US Citizens, but failure to file taxes on that illegal work is not.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ok... So in my AOS forms I will put that I am working? And do I let this employer take taxes from me giving her my SSN?

I have a friend who applied for AOS and as an Au Pair she didn't pay taxes, she was working later as a nanny without work permisson and got married to a US citizen. When she sent her information she didn't say she was working. USCIS sent her a letter asking if she payed taxes before and she said no! And they didn't say anything else back to here and she got her green card!

What do you think?

I think your friend has a good chance of getting her GC taken away for lying. They were already on to her because they sent her a letter asking exactly that. You need to file a tax return for the missing years. You'll need to file a 1040X for the missing years.

NEVER LIE TO THE USCIS. THATS RULE NUMBER ONE. IT CAN ALWAYS COME BACK TO BITE YOU.

IF/When your friend files for citizenship, it will catch up with her then.
