My friend and his wife are going through their AOS interview next week. He is concerned as he is in sales and has not made much reported this year. He is having his new employer type a letter that he makes $500 a week plus commissions which they estimate will be 50-75k yearly his employer is stating in the letter. My concern is honesty is best and what if they ask him for check stubs etc?? Will they? He really is right at or below poverty level in 2011 and YTD 2012 things have not started off well for him. Does anyone with AOS knowledge believe he will caught? And will they really deport his wife if he cannot show he is earning the 125% poverty? He sells 3 different products but times are tough as we know.

He asked his brother to co-sponsor but wow there is a lot to that if you're co-sponsor as I learned last week watching posts. His brother declined which I don't blame him.

They will not deport, but definitely look for a co-sponsor. As this will become an issue at the interview if he can't show enough evidence that he makes at least 125% of poverty guidelines.

Moved from IR-1/CR-1 Progress Reports to Adjustment of Status (Green Card) from Family Based Visas. The OP's original post states that the OP's friend and friend's wife are attending an "AOS interview" which would mean the OP's friend's wife is already in the US which means that AOS is this particular context means Adjustment of Status. The thread can be moved to another AOS forum if the wife of the friend of the OP is adjusting status from a different type of visa other than a family based visa.

So basically he's going to LIE about income? That is a serious offence and if caught (and he will be because USCIS can check your tax records) he is facing deportation with a lifetime ban. If he isn't earn enough money he should instead seek a co-sponsor. He will be in SO much trouble using that fake letter and it's totally nor worth it. Don't forget assets can also be used.

Yes I agree. This is why I posted as I am nervous about this and really it has nothing to do with me. It seems my buddy uncovers one issue then gets into another mess. And he does not have any assets. Thanks for the reply
