found out my husband has other children....

Hello,

I've been a member here for several years, but due to the sensitivity of this topic, I chose to sign in under another name. My husband and I have been married for 2 1/2 years or so. We went through the k-1 visa process, aos, etc. we're approaching the time to fill out the paperwork for removing conditions. my husband told me about a year ago (around the time our own son was born) that he has two other children that he never told me about. I was, understandably, very upset but we have been working through it. We have since been in regular contact with the children (who are not living with their birth mother but with a friend of my husband's family). My question is that we didn't claim the children on any of the other paperwork-not with the k-1 or AOS. If I would have known, we would have claimed them. I don't want to lie and I''m so scared that we're going to have issues suddenly claiming these children. They will not be moving here for the time being as we may move back to my husband's home country to be closer with them. For right now, though, we are proceeding with ROC, and I'm just so confused....I feel like we need an attorney, but I don't know where to start there either. I know it's probably a shot in the dark to find someone who's been through the same thing, but any advice would be appreciated. Should I find a local lawyer (small town) or find someone form a bigger law firm? Help!

I would recommend a lawyer who has a specialty in Immigration Law. If anything can go wrong they know who to call and who to write.

I have seen others who make mistakes. Go to bigger cities.

We listed Karen's adult children who would not be immigrating, even got their birth certs as required, and no one cared. We are now in AOS, submitted the data on the other kids and still no one cares. I thought it was only for background check purposes originally, but I can't say for sure. It was required on K1 and AOS and incomplete information was provided. That can be a bad thing but just how bad is to be determined.

02-21-2012 - AOS interview approved. EAD/AP card confiscated.

I don't believe any of this but lets assume its true.

Your husband never told you about other children. Oh please! (I never knew :whistle: ) Who writes them off on taxes and/or claims as dependants?

So, how old are the NEW MYSTERY CHILDREN? My husband never told Me! He had other children.... :crying:

I've seen some stories here but if what you say is true. You need an Attorney.

Why don't you make a real Timeline if you want to ask such a question now that you have decided to come out of the dark.

I read this as: The OP is the Immigant. The Petitioner Falsified Documents from the start.

I find it hard to consume the OP was not aware of other children being involved. Thats why the question is asked. WHAT DO I DO NOW! I don't know how it went this far with detection.

thanks for those who answered sincerely. to the others, i knew i was going to run into that. i would be happy to fill out a timeline for you. k-1 filed march 2009, approved late july 2009, interview september 2009, entry october 2009, aos filed dec. 2009, rfe in january for medical, rfe answered in february, green card issued may 2010 thank you. i have another username, but decided to create new name due to the sensitivity of the topic.

i spent 7 months in my husband's home country (in africa) and never met this side of his family. not all countries have have the same laws with filing taxes, etc. so please with hold judgment on what is already a very sensitive issue. i don't know what to do, and i've trusted the vj community in the past. i always counted myself as lucky with having an easier case, but now i'm struggling with this issue. maybe i shouldn't have posted at all. oh-and the kids are 6 and 8 years old.

robert and karen-am i correct in understanding that you failed to list children with the K-1?

Different situations: The USC has the children. Immigrating children is not the issue from what I see.

We listed the kids (hers in the UK with UK citizenship) on the K1 but no one cared. Had we not listed them things would still have moved right along from what I saw. We never planned for them to immigrate.

In my layman's view, from this point forward disclose the facts as you know them on the forms as required. The only difficulty I see, other than having a ready explanation handy if it becomes as issue, is later on once your husband becomes a USC. If his children are eligible for immediate immigration as immediate relatives being unmarried and younger than the cut-off age, there may be a question why they were not disclosed early. But as far as the removing conditions and later filing for citizenship, I don't see this as a problem. Establishing paternity later, as always is the case for fathers, I do see as a problem.

The worse thing that can be concluded is that he commited a material misrespresentation and all immigration benefits are void and he is deportable. Will it be that bad, probably not . The best case is they just oh ok and add the data to his file. The actual result will be between the 2 and probably closer to the first than the second. Lets hope he didn't forget other small things like previous wives in his eagarness to come to the US. Beleive me you are more forgiving of overlooked facts than immigration enforcement will be.

This will not be over quickly. You will not enjoy this.

tim/mav, that was an over-the-top reaction. while you retracted your attack, you did not apologize. not nice.

shes not a troll. even if she were, shes a nice one. ill apologize on behalf of the VJ community.

onwards and upwards.

find an immigration attorney. there will be precedents for this. and it seems you already know that honesty is by far the best policy with USCIS. it will get you a long way. there may be consequences, but you can deal with those if and when they come. for now, get the attorney, work on your relationship, and also take care of yourself. it must be difficult and you sound as though you are keeping your wits about you.

and yes you should have posted. i am sure your previous postings have benefited others so you are more than entitled to ask for help in a time of need.

If you read carefuly the ORIGINAL Question. There is much Confusion about what is being asked. So, what I did was read the Post and came back with questions. In the end questions (or some) were answered to help the OP. We did get a reply and better answers came that relate to the case.

When I said : I stand corrected that meant I understand better now and so did all of us. We answer questions as best we can and were not always correct. WHEN ASKED A QUESTION? THINK BEFORE YOU SPEAK. IF UNSURE? ASK A QUESTION BACK.

Members agree Legal Help would be appropriate in this Case.
