Why? Is your case a difficult or extra complicated one?

Thousands of people just do it on their own, it literally takes a few hours to read FAQs here on forum and on USCIS site.

I'm of course not trying to talk you out of throwing another thousand dollars away ;) But you DON'T need a lawyer, especially at this stage when everything is already filed. (Unless, again, your case is difficult, needs professional help, etc.)

I want to second this comment. If there are no red flags in your case, why would you hire another lawyer?

I will third this comment. If your case has nothing unique or complicated about it, why do you need to pay a lawyer instead of doing it yourself?

Sorry for your problem. I got an RFE too. I only hired my lawyer for the petition phase. I guess I misunderstood him when he said that the money I paid was up until the approval. When I got the text message, I called him and he said I would have to pay him more to fix the RFE. I told him No, I would do it myself. Little did I know they would send the original to him and not me! So I had to make nice to get him to send it so I could mail it off. I don't want any more prob so I'm not telling immig that I'm not using the lawyer until I get my NOA2. I'm like you, I wish I had found this site sooner. Good luck with your journey

I hired a lawyer, I thought he asked for too much paperwork to be submitted (more work for me!). I received notifications directly (NOA1, 2, RFE) as well the lawyer forwarding the same notifications to me every step. We got one RFE, the birth certificate from Honduras was in the wrong form (unique to Honduras, I think, why would there be two official forms for birth certificates ?). We got the right form and the lawyer sent it in, the only issue was at first they weren't sure why the birth certificate was accepted.

This is my life, this is just the lawyer's job. I keep researching all the steps and timelines to avoid missing something that the lawyer might miss.

Many countries have two forms of birth certificates, even many states do this. You need the "long form" Any attorney doing this should know that.

The birth certificate of the beneficiary is not even required for the petition. Whose birth certificate was this?

thanks all for repliesª great community on here an good to know we are many in the same boat..

i am supercareful now and even sceptical to let the mawyer answer the second RFE, to make she dhe soesnt miss any documentation...

maybe i need to do it myself...

agan she wants to ask for expedite.

does anyone know if the review of the extra evidence can be deleyed if the request for expedite is delayed?

because as i understand, then they need to look at the expedite request fist, then the new evidence..

This will have no affect on a K-1 and even if it did there is nothing a lawyer can do. If he/she told you there was something they could, they LIED knowing it would not be a problem.

One day overstays MAY affect a tourist visa entry but would have NO affect on a K-1. You do not incur a "ban" until you have overstayed 180 days.

You hired an attorney to solve a problem that did not exist.

You really need to post your exact circumstances of what happened in the overstay and what happened when you were denied. This is really important. Please post a new topic so that other members can help you.

Well, we were at the 90 day limit and we decided to go to Canada, BC and see some friends Dec. 3 years ago!

Had just met my fiancee and we were so in love that is why we stayed until the 90 days..

so when we wanted to get into Canada via Vancouver then we were denied entry because the officer thought we were not going to leave because we had not printed a copy of our return ticket to Europe as well as printed out a banstatement, so they did not want to let us in.. they told us to go back to the US immmigration to print and said they would give us one week extra to do this... but when we got there and explained their printers didnt function and also could not access my internet bank there to print..they all they could as well as talking with Canada..but that did not work--- they still didnt wanna let us leave--so the US told us to leave to the nearest airport and fly out so they did not have to deport us... we got a ride to Seattle, it was the midddle of the night and then back to Portland, or next day to see my boyfriend and tell what had happened...I was ruon all night and it was really traumatic-.. and sad...didnt know what to do... we share a very passionate and deep next night together...sad too.. and next morning we got to the airport on a plane to Mexico City---

spent some time there and in Guatemala, before we soon and put flight back to The UK from San Francisco..

so we booked a flight from Mexico City to Portland, Or..but when entering through Atlanta immigration, we were taken to an offoce with no air in...(it felt like that)...they took out passport and a couple of pieces of paper and we had to wait--- they intervied several people who were there and after a while, after missing our connection to Portland..it was our turn..

we were interviewed and asked various questions.. had to swear to be honest and honest I was telling I was on the way to visit the love of my heart whom I met land whats his nationality they asked... I answered everything honsetly innocently being in love--- and they last Fall.. where is he, whats his name and wrote and in the end made a document I had to sign all the pages on... we didnt know what this was about--- but they didnt offer anything to drink over these hours neither anything to eat and we had to pee in a prison cell that was there...-I had to ask several times to be taken somewhere to give my son food and visit a proper toilet-.. finally one guard took us and I got him some proper food...he looked at us in the lift on the way to the cafe, like what am I doing here, what are we doing to these persons lives..this young woman and child.. like..I feel sorry--- hhhmmm... so we ate and we went back with him to the office/ room..

they hadnt made a decision as to what to do for us ..but.. eventualy they did and they said: You are not coming into America today... You need to fly back to Europe..

and eventually an agent for Delta came and she helped sort a flight--- first they wanted us to fly to Amsterdam where we didnt know anyone! And the ticket would have costed 2000 pounds! I refused... could not afford that...

I said anywhere else, cvan not pay much, if you guys want us to leave, then change our return ticket... and eventually they did and we had a flight to London...

so time passed and they were busy...I asked a few times to get our passports back and said when my flight is..now will we get there?

Time passed and I asked several times who will take us there and just got the answer" Wait until its your turn Madam!"...but when it ws 10 minutes till my flight, then the lady for Delta did say that my flight ACTUALLY is in 10 mintues.. and one female worker had our passports and took us there...

When we walked she said: " Well, this is late. Do you knwo what happens if you miss your flight? That is not so nice.."...But it wasnt really our "fault" that we were so late... we had asked several times to leave---

so this is the situation... we were denied on the visa waiver program and cant travel on that again..

my boyfriend has visited us several times and we have been trevaling together as well...

we cross our fingers that we will be able to come to the US soon...

in the past before secind AMERICA visit, we apploed for a B2 but got denied due to lack of ties..

so this is our story..

i think for the K1 none of these things matter...

Thanks for your information,,,yes I do think we can do quite much on our own if we just read infor mation properly... blessings and thanks...a tourist visa could have been possible after a year or two if I would have had a stable job, a property maybe etc... things I sort of didnt have at that time..and they already knew about the relationshup I am in..

Yep, that sounds okay. It's always good to put out your circumstances so that folks can read them who have knowledge regarding.

Gary is right about the one day overstay. I just wanted you to clarify because sometimes folks leave out details...you can't ever use the VWP again--don't try because that could cause issues for you.

You should be good to go for the K1, be honest at your interview at the embassy. You don't need to embellish, but just the facts.

Best of luck! David loves all the Scandinavian countries :) I've never been, but would love to visit some day...

I neglected to say this in my response but you should include this also.

This Lawyer sounds crummy... Who was it ? I hired a paralegal , the money wasn't that much , and my NOA2 only took 22 days :) . Lawerence R Holmes :)

a new york one..

i dont want to use her again

we are awaiting noa2

an dhave paid 1900 dollar for this, supposed to include everything till visa issuance

but dnet have confidence with the work they do due to so mauch delays and mistakes

they are better at helping people with AOS..

i believe, thats what our friends in NY had use dher for and they had no problems

no iam sceptical to use her for th erest of th eprocess in case of mistakes..etc...

but have contacted another one who seems very professional and good, only thing is i need to pay 1000 dollar again for the rest of the process, but they work properly

maybe we could also do it on our own for sure

we have 2 co sponsors

i would like to save the money as much comes later again--- to pay for...LOL

i also need to get my son his k2 visa

Again, why would you spend your money this way? It seems you do not have an abundance of disposable income, so exactly what is it you think will be accomplished by hiring a lawyer (this is not a rhetorical question)? It's your business to do so, of course, but I get the sense that you haven't yet understood that it is not likely to change the outcome of your K-1 case based on what you've told us here. Specifically, what part of the rest of the process do you feel you cannot do without a lawyer's help? I'm sure people here can help guide you if you don't quite understand what you've read in the guides.

(I'm hung up on this because the OP seems a little overwhelmed in general and if I were in this person's shoes, I'd want people with experience to stop me from hiring a lawyer for something I could do myself.)
