Hello Everyone:

I am filling out the I-864 form and I don't know what to answer in question #25

My spoouse filed his tax return for 2010 but not for 2009 and 2008 (because in those years his income was too little)

So we are going write a letter and send a copy of the IRS Publication 501 showing his filing exemption as he did not qualify for filing a Federal income tax return law because his income was to little or no gross income the last 3 years http://www.irs.gov/p...rs-pdf/p501.pdf

I know that we will have to leave in blank both boxes of question #25 since he didn't file taxes in 2008 and 2009 and we only have his tax return transcript for 2010..

But my question is about the part where it says

My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax returns for the most recent three years was:

TAX YEAR TOTAL INCOME

________ (most recent) $ _________

________ (2nd most recent)$_______

________ (3rd most recent)$________

Even if he didn't file his taxes for the 3rd and 2nd more recents years, can we fill out the first line saying he file taxes in 2010 and how much was his income when he filed it??

Yep u only need 2010 the rest of other years is not necessary optional

The other recent tax returns are optional, 2010 is enough to for I-864 already.

Incorrect. The USC MUST have filed for the previous years. While attaching the returns themselves isn't required, income information IS required as is a letter explaining why no tax returns were filed (if they weren't). If taxes weren't filed but you were supposed to you MUST file back taxes.

Yep u only need 2010 the rest of other years is not necessary optional

Please see reply above. You MUST complete the info for all years. If his income was too low you can write $0 but you still have to include letters for the missing years stating why he wasn't required to file.

I mean the copy of tax returns... If the other 2 years are exempted then you put exempted in the filling and with an explanation on the cover letter.

I can't complete the info for all 3 years if he didn't filed his tax returns in 2 of them , why should i complete the second and third line?I think i will complete only the first line with 2010 and his income for that year because that was the only year he filed his tax returns and i will attach an letter saying why he didn't file them.

This is confusing..

I can't complete the info for all 3 years if he didn't filed his tax returns in 2 of them , why should i complete the second and third line?I think i will complete only the first line with 2010 and his income for that year because that was the only year he filed his tax returns and i will attach an letter saying why he didn't file them.

This is confusing..

Put N/A there then. You don't attach a letter saying he did not file. HE needs to write a statement of explanation about why he did not legally have to file taxes for those 2 years, and sign and date it. If he did not make enough to have to file, then include the IRS Pub that states the income requirement for having to file taxes and that he was below that amount.
