:innocent: Ok here's the thing my fiance was refused a visa at the time of his interview. The IO didnt say why it was refused. I am thinking that It could be that I only visited him once and the fact that in the same month of my divorce I filed the I129f form. I am confused because I really don't know waht it could be. At the interview they asked my fiance about my previous marriage and about my kids and then the IO asked him why he never filed for himself. At the same time they kept everything except for his passport and the IO gave him back the pictures of us. What do you guys think it maybe?:bonk:

What do you guys think it maybe?

well.. your marriage did not convince the immigration officer. I'm sure the officer had to provide some documentation upon returning the documents to the applicant. speak with the fiance.

I have already. thats how I got that much information, I was thinking of maybe the question that the IO was asking was what he had doubts about.

well.. your marriage did not convince the immigration officer. I'm sure the officer had to provide some documentation upon returning the documents to the applicant. speak with the fiance. While we are in AP status we are trying to work on a more stronger case before we are giving a second interview.

The only way to know for sure is to file a Freedom Of Information Act request for the Department of State asking specifically for the consular notes on your returned petition.

The things you stated in your post are surely red flags and it is very possible the consular believes the relationship was not legitimate.

It is surely correct that you have some red flags in your case. The fact that you met this man while you were still married and the fact that you have only visited him once before filing for him. If you truley want to be with this man, I suggest you marry him and file for the I-130. Good Luck!

suggesting marriage to overcome what is assumed will not change a thing. She should not just get married and go file another I-130 with even knowing the reasons for the denial. One person suggested contacting the necessary dept. and getting info on the interview/denial.

AMEN!!

When a case is sent back to USCIS because the consular believes the relationship is not legitimate NVC puts a fraud marker on the case! The reasons for the IO's concern will still be there and MUST be overcome! It is possible the things the OP posted are the only hurdles, it is ALSO possible the IO found other things the petitioner is not even aware of!! She needs to know WHY the K1 was denied before she does anything. period.

I think the reason why the IO asked my fiance that ? was he was being sarcastic, my fiance was furious when he said that because the IO was already like grilling him really hard. My fiance told the IO why would I apply for myself and she has already filed the petition for me. I can't marry him because when he checked in before the interview they made him sign a petition stating that he will only get married in the states. Thats good because it just give us time to make a stronger relationship to get better proof of the relationship.:unsure:

So did he recieve a 221g or did they tell him visa refused today and gave back all the evidence?

You will eventually get a notice as to why they did not issue the visa. DO NOT do anything before then if you do not know the reason. Getting married will NOT fix whatever the problem was because being married is not required (or allowed) for a K-1 then it is certain THAT is not the problem and the "problem" cannot be corrected by getting married. However if a spouse visa was denied, you would still be very much married.

If you do not know what the problem was (most likely the usual vague "not enough evidence" or "visa for immgration benefits") then you can re-file the K-1 and do a better job with the evidence (and attitude) next time. Understand that THAT officer he deals with has complete and absolute power to deny your visa and delay you for many months or years. DO NOT get smart @ss with them!
