Husband just had interview in London and even though we have a joint sponsor and everything went through the NVC they didn't approve him because they say we need a joint sponsor...I'm very confused and don't know what to do next. They gave him his passport back and told him he didn't need another interview. Thanks for any help in advance.

If you had a joint sponsor I would call and be sure they saw the joint sponsor you may just need to resubmit that info... it could be they didnt approve of the joint sponsor you had and if that's the case then you would need to find another one and submit that info...

But I would call and find out for sure.. ask your husband if he has anything written down suggesting the joint sponsor you had was rejected or if they were simply saying you need one.. ive seen where they simply didn't see that info in the file and ive seen where they have rejected the joint sponsor for various reasons..

Good luck

They acknowledged the fact that we have a joint sponsor. The NVC told me directly that she made enough so I'm really angry about this. Does she stay as a joint sponsor and I just need a joint sponsor to supplement what she doesn't cover or do I need a whole new joint sponsor to cover everything?

NVC doesn't approve the joint sponsor- they have a first look and may let you know if something is glaringly obviously wrong, but it is the embassy that approves the I-864.

First off I wouldn't call the embassy except to get the email code to actually ask any questions of an officer. The people that answer the phone won't be able to answer your questions.

The sponsor falls short on income because $27,937 is needed. Perhaps the assets were not considered readily convertible to cash (like selling the rent houses). Perhaps assets were not proven (like an official and recent appraisal of the rent houses). If there were cash assets like large savings accounts, perhaps those weren't proven. Without seeing every number and document you provided, then it's hard to guess. If you can organize an email to the embassy and tell them you can't get another joint sponsor and need to know if there is a way you can further prove the current sponsor qualifies. Detail the reasons why you think your sponsor qualifies and give all the figures and documents you provided to support the claim, then perhaps an officer will give you more information.

If you get a different joint sponsor, they have to qualify on their own, not in combination with your current one unless they live in the same house (with each other) and are related. Household members can combine incomes.

The consular officials have the final say....if they require a qualified joint sponsor, that's what you should provide. NVC does not issue visas. NVC does not adjudicate I 864's. Your thoughts on the 'complete' case are not relevant. It seems as though the consular official found something amiss with the sponsor and gave instructions. A senator or congressman cannot overrule that decision.

They usually don't deny a visa outright on financial grounds, they give you at least one chance to find another co-sponsor, or submit additional documents, as in this case. But yes, the CO can and will deny if the I-864 is not sufficient and you cannot come up with an alternative, even if you waited 23 years for an interview as some categories do.

BTW, USCIS do not approve any visa, they approve the petition. Only after USCIS approve the petition do you actually apply for a visa.

Did the CO specifically tell him that you will need a different Joint Sponsor? Did they give him instructions on couriering any paperwork back to them at all? Were you at the interview? I agree with Nich-Nick, e-mail the embassy and find out exactly what the issue is. Best wishes for a speedy resolution.

i was think if NVC send e-mail say "The applicant's name has been placed on the list of documentarily qualified cases awaiting the availability of visa numbers"

that mean USA embassy will check my Document only
