Hi Y'all,

Visa approved - YAY!

I'll be flying into the US five days before our second anniversay. In the info I've been given it says I'll have conditional

permanent resident staus since we havnt been married for 2 years (by five days)when we arrive. I have to file a joint petition with USCIS to have the conditional status removed "within the ninety-day period immediately preceding the second anniversary of the date you were granted conditional permanent resident status".

Anyone done this before? It appears I have to file the petition within the 90 days after my second annivery of the visa issue date that is now in my passport?

Correct??

I got a bit confsed with the whole wedding aniversary - thinking that it was after my second WEDDING anniversay that I had to petition, but it clearly appears after the second anniversary of the visa issue date?? so I'll be in the US for 2 years before filing anything??

You apply 90 days prior to the expiration of the conditional Green Card.

I have read that some people have gotten rejected because they send there form in 3 months prior and it's a couple of days early. :blink:

any hope of delaying yer flight a week?

The trade off is a 10 year green card, no further hassles with USCIS.

You'll have to carry yer marriage certificate and be adamant with the CBP officer, that you want an IR-1 designation at the POE. But it's do-able.

Whatcha think? Is a good trade off, I think so !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

It's filing paperwork and paying a fee in approximately 2 years. Nothing different about your status.

If it makes sense to do so, delay your entry into the US. If it doesn't, look over the requirements for adjustment of status and collect the needed documents over the course of the next two years.
