HI GUYS ME AGAIN!!

I HAVE A VERY QUICK BUT IMPORTANT QUESTION! SINCE I AM THE I-129F PETITIONER FOR THE FIANCE VISA, WILL I GO TO AN INTERVIEW BEFORE MY FIANCE COMES TO THE STATES? AND WHAT SHOULD I EXPECT?!?!? I'M A BIT WORRIED!!

ALSO I HATE TO ADMIT THIS BUT AS I MINOR BEFORE I TURNED 18 I WAS ARRESTED TWICE , WILL THAT JEOPARDIZE MY FIANCE'S CHANCES OF COMING HERE?! ;( I REALLY HOPE MY REBEL AGES DOESN'T BITE ME IN THE BUTT NOW :(

IF ANYONE KNOWS LEGITIMATE ANSWERS PLEASE HELP!!

The beneficiary goes for an interview in their country. The petitioner does not have an interview.

I'll let someone else answer the arrest question, since I'm not sure how any of that side works.

My understanding is that an arrest under the age of 18 does not go on your record, so I would not think those arrests would be a problem for you, but I am no authority on this.

What point are you at in the process, have you received an NOA2 from USCIS yet? :time:

The reason I ask is this, while it is rare, sometimes the service center will tag a petition and send it to a local office to interview the petitioner prior approving the petition. If you have already received your NOA2, then you don't have to worry about this.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Back in 1982, I was charged with a felony of fraud, no jail time, 3 years probation and restitution. For almost 5 months I was holding my breath worried about the consequences this would have on my approval, but thanks to God, I was approved on August 29th. I think it really depends what the arrests were for, the outcome and how long ago they were and your history since those arrests. Also, if you were a minor or not.

With regard to being interviewed, I have seen a very small percentage being interviewed but usually after the approval of the I129F.

unless you are a sexual predator or other similar crime covered by the Adam Walsh act, the petitioners past run ins with the law are not a factor in the petition approval process

It seems even if you're petitioner is a sex offender, you're still able to come over to the US on a K-1 Visa. A coworker of my cousin came over from The Philippines 4-5 years ago on a K-1 Visa. Her fiancee a few years prior to filing the K-1 visa was arrested and found guilty of possessing child pornography. He was prior military and was discharged (USAF Article 134) after the conviction. He then met her online, went to Philippines to meet her and filed a K-1 Visa afterwards. She was approved. Now she's filing to be a US citizen soon.

I don't know all the details to their case, but just referencing what my cousin conveyed to me and by looking at his sex offender profile on the state database.

You are probably right on that. Estimating on when she arrived here and the passing of the AWA, I would say she was extremely lucky with her timing.

Only because I pulled a lot of details out of my profile, to shield my identity, I will say that I have a worse record than this and I was approved personally and I DID time (1 year on two 3 year sentences runing concurrent). A 2nd and 3rd degree felony, but 18+ years ago. I only post this for the benefit of others that are worrying about thier past criminal records. My life has been a beautiful dream following that with owning a business, going to an ivy league university and changing my life around. I'm not perfect, but a day at a time has done me wonders so those of you reading this and worrying about your records, a long time ago even with serious charges I think they are reasonable.

While illegals invade the USA and get free benefits, we wait paying fees and filling out forms while the illegals fill out zero-thank you US politicians!
