Denied for "212g4" that is "you are likely to become a public charge." Then returned the passport...The next day, the Philippine embassy called and told her to report to window xxx with her passport??? I had well over 2.5 times the proven income by the 125% regulation. And even more assets from home equities? I am at a loss as to what is going on?

Public charge???? I am at a loss as well. This is going to make for an interesting topic. Have you tried calling DOS maybe? That would be my first thought.

I hope someone comes along that would know how you should proceed. I am sorry you have to deal with this and wish you the best of luck

Well they told her to come back, sounds like someone called them on the mistake and now they are wanting her passport to issue the visa?

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Thank You for your kind remarks and optimism. At this point, I did call the Embassy and got a nonsensical "ask your fiance" which she always keeps me updated to the second. And no one can speak to the consular or contact them about his decision as he has total discretion. I pray so hard you are correct, and that in his haste, he failed to look at all the documents and overlooked the proof that I gave them...I can only wait and see today that is in about four hours what this actually means. But I can get a co sponsor I-134 without an issue. Its just so embarrassing in a way, and I don't understand why these things aren't settled well in advance in the NOA2 stage at the US NVC...Then it would be so much easier to rectify without delay...Or is that just too logical? But thank you so much for your blessings and support.

I too have thought that they should straighten out the financials right out of the gate. It makes more sense. If someone is unable to support their beneficiary, why go through all the hassle of forwarding the petition to NVC and then the Embassy? Though if they did it this way obviously the petitioner should be able to prove at the time of the interview that they have maintained their financial situation.

I used a cosponsor and I even went to my fiances interview, had we been denied because of sponsorship issues I would have felt probably the same as you :ranting:

You said they asked for her passport back. Sounds to me like they realised the mistake and are issuing the visa. I wouldn't freak until she's been back and you know what's up.

Now that I reread this, it does sound like they are going to issue her a visa. They wouldn't have had her return and submit it. I didn't catch that part. Im off in LaLa land today :whistle:

I want to go to the interview as well...how did that work??? did both of you go into the interview? or did they make you wait outside???

I was allowed to go inside. The only time I was asked to leave his side is when they performed the actual interview. Every consulate is different. You should check others post for your consulate and see if they were allowed inside. Good luck! :thumbs:

Wierd. Can you give us some details? Are you W-2 or self-employed. IF W-2 did you provide last 2 paystubs and last years tax transcript? If self-employed did you provide last 3 years of tax transcripts? Just curious as I haven't read of anyone getting denied when WAY over the 125% requirement.

Go to interview take documentation, hope for the best. Can't see them asking for a return for any reason the good. But we are dealing with the government.

I would have hope for the fact that they kept her passport. If they were denying the visa outright, why would they need the passport?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

If they want her passport, she will get the visa. If you are over the poverty line and provided enough proof there is no way they can deny her visa based on lack of financial support. I think they overlooked it and wish to rectify the situation. Good Luck!

Says who? I agree that the visa should not have been denied, but at the end of the day the CO can do whatever they want.... even if the Petitioner is way over the poverty limit.

If you are over the poverty line and provided enough proof there is no way they can deny her visa based on lack of financial support.

Ready, Yes, I provided w-2's from pensions, tax returns, notarized letter from bank c/s statement of all deposits and current balances, house deed from assessors office. Since last post, Fiance said the lady told her she would be receiving passport by courier? I am under the assumption as most of you, (glass half full) that it was re evaluated. But also agree with Ready...As we are dealing with a government institution who has absolute power and discretion with no oversight. This has been the hardest part of the whole process. I called again, and got a very good c/s at the embassy, and said he would email the immigration dept my concerns and get a reply...So far, nota...
