Hi Guys!

I just got married a couple of weeks ago and we're filing for AOS. My problem is I do not have a social security number. I was born in the U.S. and have always been able to get a U.S. passport with no problem. I've applied for a social security number but there has been some delay in validating my birth certificate so I'm still waiting for a number. I heard that it is no problem for me not to have a number for AOS since I have a joint sponsor for the affidavit of support. Is this true?

You should be able to get a social security card in a timely manner if you are a US Citizen. I would imagine that you will still need to have the SS # still even though you have s sponsor for support.

Am I under the impression that you are not living in the USA and that is why you don't have a SS # ?

Otherwise you would have had a SS # because US parents would have needed it when doing income tax returns and using you as a dependent.

If you search here, you will find another petitioner who chose not to get a SSN because they wanted to stay off the grid, and this person was able to obtain a visa for their spouse.

Though, as a USC you do need to report all of your income worldwide for taxes, so if you have not done that, you will need to. Good luck.

This is incorrect. You don't strictly "need" a SSN. It does not get you a passport, you do not need it for a job, and you can use a ITIN number for taxes. If you searched you would find at least one other thread about it.

This is incorrect. You don't strictly "need" a SSN. It does not get you a passport, you do not need it for a job, and you can use a ITIN number for taxes. If you searched you would find at least one other thread about it.

That thread was very funky dubious Urban legend type story IMHO.

So if you don't "need it" for a job how does employer do proper withholding?

I can see a non-citizen getting ITIN for tax purposes, but would they really issue an itin to US Citizen for wage and earning witholding purposes?

The W-7 specifically says "For use by individuals who are not US citizens or permanent residents" in addition to a bolded statement that bars people from submitting the request if they are even eligible to receive an SSN.

IRS regulations in the federal register also specify that it will not (knowingly) issue an ITIN to a USC or LPR.

Thus, it is safe to say that a USC cannot be issued an ITIN. However, even though the W-7 is signed under oath, I guess there's nothing stopping a USC from obtaining one. You would just have to lie that you are not a USC or LPR.

You do not, however, need an SSN to get a passport.

Yes, working your way around the SSN for work purposes is probably impossible, and would involve illegal activity.

I think in that previous thread, the petitioner was extremely wealthy and did not need to work for a living. In this case, the OP probably has never worked in the US (it seems they are abroad).

I tend to believe it is possible to live as a USC without a SSN, under very specific and rare circumstances, that probably involve never actually working.

Right, and luckily, we don't (yet) have a national ID system and it's a shame that all too often an SSN is considered as such.
