I am trying to find out if my friend that have a 10 year green card can divorce his wife and be able to stay in the usa.

He have a sponsor that happens to be his wife´s mom and dad, can they revoke the sponsor ship and if they can what will happen to him? will he be able to stay or will that force him to leave the usa?.

Reason for the divorce is that she is cheating on him.

They have been married for 6years but he have only been in the usa for 2½ years, and i want to see if i can help him with this matter as he dont know where to turn or who to turn to for help.

I hope that someone out there can give me a answer that can help him out.

He already has the green card they cannot take away their affidavit of support that they signed for him.

Its a done deal he has his green card. He can get a divorce and move on with his life. He can stay in the USA but will need to notify USCIS that he has moved since he is a green card holder.

He already has the green card they cannot take away their affidavit of support that they signed for him.

Its a done deal he has his green card. He can get a divorce and move on with his life. He can stay in the USA but will need to notify USCIS that he has moved since he is a green card holder.

He have had his green card for alittle over 2 years now, an i tell him that he can get out when ever he want and that he can stay?

I have tried to find the answer on USCIS webpage but i cold not find anything about it

Like Inky said, if he has his greencard, he can divorce anytime and nothing will happen to his immigration status. The Affidavit od Support is in effect and they cannot withdraw it at this point.

Like Inky said, if he has his greencard, he can divorce anytime and nothing will happen to his immigration status. The Affidavit od Support is in effect and they cannot withdraw it at this point.

Thank you for the info, i cant wait to call him tonight and let him know what he can be free when ever he want to and still stay there in the usa.

He just needs to make sure that he keeps the card up to date or gets US citizenship after 5 years. Make sure he does not let his card expire.

He just needs to make sure that he keeps the card up to date or gets US citizenship after 5 years. Make sure he does not let his card expire.

I just talked to him and it seems like his laywer told him that he could not do it when he asked about it some time ago?? where in the rules can he find it ?

He most certainly can apply for citizenship 5 years after the divorce.

10 year card is renewed every 10 years by filing a form by himself.

Fire that lawyer and never speak to it again. If the marriage is not working he most certainly can file divorce and stay in the USA with his green card. This lawyer is VERY mistaken and giving bad information.

The lawyer is a moron. Your friend has a 10 year card. No restrictions. He can divorce his wife and move on. He DOES need to notify USCIS about his change of address though. He also is eligible for citizenship 5 years after he became and LPR which means around 2 1/2 years from now (you said he's been here 2 1/2 years).

sorry typo. 5 years after he became an LPR (legal permanent resident).. i.e. got his GC.

not even the worst of the ambulance chasers who took the bar exam 10 times would say that. make sure you get the right info from your friend.
