Is it possible for my fiancee to Submit I-129F to USCIS even we have not meet yet???

Me and my fiancee haven't meet in person yet,but we are planning to be engaged within 2-3 months on his next vacation.my fiancee works in asia but as of now its his vacation for a few weeks and spending it with his mom in the states,my question is that, is it possible for him to submit I-129F at the USCIS while he is in the US even we have not meet yet? does anybody know what are the requirements in filing I-129F? please let me know if you have any idea..thanks much

Part of the eligibility requirement for a K1 visa is that you and your fiance must have met each other, in person, at least once within that 2 years prior to the filing of the petition petition. There can be exemptions however you must be because of the following reason:

1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.

2. If you prove that the requirement to meet would result in extreme hardship to you.

It is possible to send I-129F now even you guys have not met in person yet BUT you will get an RFE for that or worst case is they can deny it cos the main requirement for I-129F is you guys have met in person within the last 2 years before the filing.

June 18, 2012: Visa picked up at the embassy

They can send the I-129F but USCIS will deny it :bonk: for lack of proof of meeting in person within the last 2 years.

Therefore, they need to meet first before sending/filing the I-129F inorder to avoid denial. :)

Guys thank you so much to all who answered my questions.we could have met already this month but bcos of the phil. immigration restrictions they asked me some documents before they let me fly in which it would take time for my fiancee to get that kind of document grrr...we planned to spend time together in other country but it didnt happened.

Short answer is no, read the requirements, everyone here who try to beat the system some how has problems. This process if challenging at best even if you do it right. Good Luck.

It does not matter where (but I guess you know that already), but when, the when is before filing. How long is not important either.

You never can tell if ur so called fiance is a 'monster'.

So meeting in person is necessary and its a mandatory requirement from USCIS.

You cant file without meeting in person, otherwise ur petition would be denied for lack of this and RFE issued in that order.

You don't have to rush this process. Remember, its worth the patient, waiting etc...

Afterall you intend to spend your lifetime together. So get to meet first.

Is it possible? Yes. Will it be approved? Probably not. Besides, you have to submit pictures of the two of you together with the petition package and you can't do that unless you've met in person.

It will absolutely NOT be approved, not "probably not." It's a very clear-cut, black-and-white, shout it in your face requirement. You do not need to submit photos of you two together but you MUST submit evidence that you met in person in the last 2 years.
