Timeline

; 2011 (current) is more important than the past 3 years. If your fiance has a stable income and makes above the normal poverty line, than you shouldn't worry.

Though, make sure you add more proof in case your fiance is just right above the poverty line, such as banking information (savings, assets).

the irs just might disagree... have you ever heard of a sub-lease? in essence this is what it could be

A Lease is the Same as Renting. A Lease is a Legal Document that specifies a Time period between The tenant and Owner/Landlord for the Period on the Lease/Contract between the 2 parties involved in the Contract/Lease Agreement.

This Post is surely 2 parties sharing rent. Maybe the petioner never stated to the Owner of the Dwelling that he has a Roomate. That will not matter.

If the Petitioner had a Rent to Own Clause that might be different but see No indication of that. Or any indication of IRS documentation that the Income was Taxed.

you do not have to be the owner of property to create a rental income situation... You do not have to have a formal lease agreement to create a rental income situation. The issue here is that most people will ignore the rental income received from a rented room though technically rental income.

I think the Currant Year is more important that last year also. I have read: The Philippines wants to go back 3 years.

We prepared 3 past years of tax transcripts for the interview but they returned all but the last year to me (without even looking at the others). I was told only the last year was needed. Also submitted bank statements and other proof of income.

Dec 05, 2011: Received U.S. permanent resident status (AOS based on K-1 visa)

Dec 16, 2013: Removal of conditions on green card

Apr 28, 2015: Became a U.S. Citizen

My fiance's income is also not sufficient base on the poverty line so he got his dad to co-sponsor. But during my interview, when the consul asked me about financial support, i mentioned to her that my fiance has a joint sponsor. The consul said that they don't allow co-sponsorship for K1 visas. I was stunned. I couldn't believe it because my fiance even asked USCIS if it's okay and they said there shouldn't be any problem. Anyway, i insisted, then eventually she got my docs for joint sponsor. She still placed me under 221g. So i submitted the docs they're still asking. Last thursday, they delivered my visa. :) I guess some consul allows it and some don't but it doesn't hurt to ask and be persistent about it. If you think that your fiance's income is really not enough, better to have a back up plan...get a co-sponsor. God bless!

His priority is to be able to reach poverty guideline. How much $$ should he have on bank to put us in safety net with all this financial #######? sorry just getting stressed out now...

and yes we are now waiting for manila case# but right now im not that enthusiastic about that coz of this financial stuff

Darnell answered this just this week. I may have to go this Route as well. I think you will need your MNL# Issued after your NOA2 and sent to NVC and then to the Consulate in the Phils. (Philippines) to do this. 2008, 2009, 2010 are fine but 2011 is not looking very good.

Never hurts to read. To me it makes good sense what Darnell Posted.

Thats Amazing! I guess we learn from eachother everyday. The Phils is known for Not Accepting Co-Sponsors.

Yes, that is true because after I was placed under 221g, we researched about having a joint sponsor for k1 visa and my fiance read from one of the sites he checked that it's only in the Phils. that co-sponsorship is not allowed. When we learned that our heart sank. But we still kept the faith. It's really amazing and I consider a miracle that we were approved. Oh also, a few weeks before my interview, my fiance lost his job. So if you ask me how we got approved? I really don't have a precise answer but I just know one thing, it must be God. :)

What is 221g? ya i don't understand why US Em in PI doesn't approve co-sponsors and for that we are skeptical in getting one but my fiance is gonna get his mom or brother as cosponsor. His priority is to be able to reach poverty guideline. How much $$ should he have on bank to put us in safety net with all this financial #######? sorry just getting stressed out now...

and yes we are now waiting for manila case# but right now im not that enthusiastic about that coz of this financial stuff

221g is a section of the Immigration and Nationality Act which says that the USEM is unable to complete the processing of your immigrant visa application because it's either they still need more time to review your case or you need to submit additional documents that they feel you still lack in order for them to continue the processing.

That's what they look at the current year...2011

They may look at last year 2010 tax transcripts but as long as current year is above wht your poverty line is you should be fine

Current income, not "current year" income is the key. It's not the same thing. If you lost your six figure job May 31st you have a really good current year income but are unemployed "currently". You may have been unemployed from January through May and started a new well paying job June 1st. Your "current year" income would be low but your "current income" would be great.

It's not required to submit three years of tax returns. They are going to look at your current sustained income.

I have my interview on Wednesday in London, I am having my future father in law co-sponsor me. I e-mailed the consular to discuss this and they told me to bring 3 years worth of his tax returns.

Anyone have any experiences of co-sponsor in London? The whole thing is freaking me out, not getting much sleep :crying::help:

The American Embassy in Manila sometimes accepts cosponsors for K-1erz. It's worth a try. One thing I would do if I were in your shoes would be to submit an I-864 from your cosponsor along with your cosponsor's I-134. It would show the consular officer that you most likely will have a cosponsor available when you adjust your status in the U.S. This worked for a friend of mine.

Your fiancé can also use assets like cash in the bank to offset the income requirement. I think the ratio is three dollars of assets equals one dollar of income.

Also, in my opinion, I believe it would help if your fiancé attended your interview. Then he can make a personal appeal to the consular officer. I have seen that work before.
