if we get denied cause of financial issue, if we can prove that the current year we made is enough .. will they allow extension for that

That's what they look at the current year...2011

They may look at last year 2010 tax transcripts but as long as current year is above wht your poverty line is you should be fine

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

Just kidding. Sorry, couldn't resist...

The finances are a kicker. It amazes me how many people go into their interview with no cosponsor and unable to meet the minimum guidelines themselves. As if there is a possibility the requirements might be forgiven just for them.

If you are at all unsure as to whether you will make the black and white cutoff, then go out of your way to secure a cosponsor. Even if you only hold it in reserve in the event it is needed.

this is the part where we are very stressed at...

bottom line is he doesn't make enough... barely made it the line... he is renting a house and charges roomate.. and he is wondering if he can declare the rent?

Darnell answered this just this week. I may have to go this Route as well. I think you will need your MNL# Issued after your NOA2 and sent to NVC and then to the Consulate in the Phils. (Philippines) to do this. 2008, 2009, 2010 are fine but 2011 is not looking very good.

I think the Currant Year is more important that last year also. I have read: The Philippines wants to go back 3 years.

My fiance's income is also not sufficient base on the poverty line so he got his dad to co-sponsor. But during my interview, when the consul asked me about financial support, i mentioned to her that my fiance has a joint sponsor. The consul said that they don't allow co-sponsorship for K1 visas. I was stunned. I couldn't believe it because my fiance even asked USCIS if it's okay and they said there shouldn't be any problem. Anyway, i insisted, then eventually she got my docs for joint sponsor. She still placed me under 221g. So i submitted the docs they're still asking. Last thursday, they delivered my visa. :) I guess some consul allows it and some don't but it doesn't hurt to ask and be persistent about it. If you think that your fiance's income is really not enough, better to have a back up plan...get a co-sponsor. God bless!

Thats Amazing! I guess we learn from eachother everyday. The Phils is known for Not Accepting Co-Sponsors.

Probably not. If he owned the house and didn't live in it then he could declare the rent he collects as income.

I would would think NO. Being the Homeowner Versus Renting are 2 different things. There is Nothin to write-off if they both rent and Share exspences. Rent Payments are paid by Net Income. The Petitioner would have to Own the Residence and show proof as Income . Having a Roomate and does not Own the Dwelling is Not Countable for anything except a Dosmile, place to to live. The Rent payment being paid is not acceptable as far as Income. We all need a place to live. There would be no added Income for this is what I think.

Timeline

The Income for a Roomate If Your Own the Dwelling. Is Countable as Income. There as: Submitted with Proof and You pay Taxes on that Income. That is Countable . Generally, Americans never do this whether they Own or Not. Shared Rent is Not Countable Income unless you provide proof you Own it, maintain it and pay taxes.

You can have a Roomate and declare the Income but you cannot be a renter as well.
