my fiance she went to her interview few weeks ago and said she cant get the visa because i the fiance didnt fill out a affidavit of support form because i am in medical school and i have no job and pretty much no support but still filled out the application and sent it. the interview person gave her a 221(g) forum denial of application and said she would automatically get the visa.

doesn't she have to go through a second interview? what happens now that the 221 (g) has been denied?

sorry to hear this...

the fiance/spouse ALWAYS has to fill out an affadavit of support form as the MAIN sponsor even if they have no income. You have to get a joint sponsor to fill out another form saying they will co sponsor her. I'm not sure about the k1 visa if they accept co sponsors or not. You need to do some research to figure out what else you can do. If you can't support her they wont let her come. If you have no income then what will she do? these are the concerns for them....

and im not sure what you meant by the interview person gave her 221g form denial of application and said she would automatically get the visa? If she is denied there is no visa for her. Can you clarify that part?

Did her 221g ask for more documents?

There is no second interview. You must submit an affidavit of support regardless of your income. If your income does not meet the requirement then you would need to secure a joint (co) sponsor. That person would also submit an affidavit of support along with all supporting documentation.

Whomever recommended that you not supply an affidavit of support for the interview was poorly informed. I recommend that you read the guide here on VJ to learn what is needed as well as the K1 and US embassy forums.

1) Find out if India allows co-sponsors for K1 visas: ask in the regional sub-forum.

2) If India doesn't allow co-sponsors, but you can find a someone willing to sponsor, then you could get married and then file for CR-1 visa, for which you will be able to use a co-sponsor.

3) If you can't find a sponsor, you may have to wait till you are able to sponsor her.

I already do have another co-sponsor who is my cousin. we turned his sponsor form in and also mine which states i have no income.

she got a 221 (g) document which says the visa application was denied but needs to turn in the affidavit of support forms. which was done. so now what happens?

Information is missing here. Please try to find out exactly what the 221g says, is a box checked with the information relevant to your specific case ? It is a generic letter and not everything applies to everyone. So check if a box has been ticked or if something was hand written on it by the CO.

It is very hard to figure out by the info you provided what exactly went wrong here. Have you tried to contact the embassy by phone or email ?

You can call DOS at 202 663 1225 press 1,0, to ask if they can see any notes on your case. Have them make an inquiry if you can not get any response from the embassy. From what I read into this you are on AP until they are satisfied with the financial information and that she would then be approved.

We need more info in order to help you. Does India allow co sponsors ?

i actually dont want to marry her anyway so i was hoping for the denial. since it's an arranged marriage.

this is what the 221 (g) says: Administrative Processing: 221(g)

If your visa application was refused with a "221 (g)" notation for further administrative processing, please read the instructions below.

The Consulate cannot provide additional details on your case status. This processing is mandatory, and cannot be expedited. We cannot predict how long this process will take as it varies based on the individual circumstances of each case. When the administrative processing on your application is completed, you will see your CEAC barcode in the report below.

yes india allows co-sponsor.

It looks like it was refused until AP is complete. It isn't a denial. The AP is in process...

Um, yeah... Sorry to tell you but you're not denied. You're just in AP. If they kept her Passport then once AP is finished she'll get the Visa delivered to her. If they returned her Visa then she'll get notice to return to the Embassy with her passpost once AP is done.

even though i gave no income to support her they will still give her the visa?

Forget the visa, forget affidavit, do her and yourself a HUGE favor- Do not marry or proceed further if you dont want to marry her. It will not work in your favor and will be devastating for your spouse. You can withdraw from the process anytime!

wish it was as simple as that ... its an arranged marriage i cant get out of it unless the visa is denied

They wont issue a visa until you have an affadavit of support which is enough to support her... if they request a joint sponsor which IDK if k1 visa allows then you have to send it or they cant complete the case.
