Hello fellow members,

As some of you might have read my previous topics, im almost ready to file the I-751 packet. Recently my wife and i have decided that we are going to go our seperate ways and end the marraige. This making me panic about my whole situation in regards to obtain my 10 year greencard.

A pretty random question here but what if a spouse comitted adultery on the other? The spouse commiting the offence being the American citizen. How will this look to the Government and how will it affect the whole process? Will it do the 'alien' any good or make matters worse?

As long as you can prove that you entered the marriage in good faith you are good to go, USCIS doesn't care about who cheated on who.

Agree with Katie. Won't help, won't hinder. I suppose it DOES show that it's not the immigrants "fault" the marriage ended but she may have cheated on your because you're an a**hole or because you cheated first (but she doesn't get to tell her story) so really it won't help to approve or deny you. Prove the marriage was entered into in good faith, that's all that's needed.

Has he to prove that the marriage was entered in good faith or that the marriage was in good faith when he entered the US?

He came to US on K-1, so not applicable.

Has he to prove that the marriage was entered in good faith or that the marriage was in good faith when he entered the US?

CR-1 Timeline

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.

When filing the I 751 as a divorcee, the alien must prove the marriage was entered in good faith whether they entered on a K1 or a CR1/IR1 visa.
