Fiance deported - what to do next?

Hi All,

Im brand new here and am not sure what I am doing but I do know I need help and advice.My boyfriend/fiance of two years was deported out of Port Canavral, Fla after we got off a cruise ship. Im a U.S. citizen he is an Italian Citizen...he was here on a B1/B2 visa. He would return home every 6 months and come back here and was living with me and my children. We were a family. He was deported and now is in Italy. I am filling out the paperwork for the K-1 visa and also we have the I-212 filled out for his deportation. The latter is supposed to go to Port Canavral and the other to the Vt processing place. Which one do I send first? Can I send them at the same time? Do I tell the Vt St. Albans, processing place about his deportation and do I tell the deportation people of the pending K-1 visa app???

PULEEEZ someone guide me. I spoke to an immigration attorney and he didn't even know which you file first or even if they should go to the same place instead of the I212 going to Port Canavral. We lived here in Ct. This process is overwhelming and we just finally got the $$ together since Sept 30 to go forward and now I feel stuck and afraid to send something at the wrong time or place. Is there any kind of help line someone can call when filling out this paperwork..where they can speak to someone from USCIS? I went to an office and they didn't know ANYTHING about anything!

Any and All help would be so appreciated.

I am exactly in the same position right now...the same thing happened to me :( I really dont know what to do now?? Did you apply for K1 and the waiver?? My lawyer said we should get married so I can apply for I-130 and the waiver?? They saying it would be better if we would do that but I am really lost and dont know what to do .

Please advice!! I am so lost:(

You need to file either the k1 or cr1 paperwork and the paperwork for the waiver. You may want to see a lawyer because the waiver has to be strong enough to make them want to forgive your SO for being here when he should have been.

This will not be over quickly. You will not enjoy this.

first, welcome to Visa Journey.

Second, it is not a good idea to find old threads and then ask for follow up. The member who started the thread you originally used has not been active on Visa Journey since March 2008 and you would be waiting a long time for an answer. It is much better to state the circumstances of your own situation here in its own thread and not in some one elses'. That way, our members can give you the best advice that is specific for you needs and not for someone else.:)

You can apply for either visa, but many agree with your lawyer- a marriage (ie CR-1 visa) gives you a stronger/ legal relationship, so the hardship waiver is easier.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What was the basis of the deportation? Was it an overstay? If its an overstay and there is an I601 needed they will be filed at the Embassy after the VISA is denied. If the I601 is approved then most likely so will the I212.

You might need an attorney who deals with removals to figure out the I212 on the finace VISA almost certain you have to wait to be denied the VISA then apply for the I212 or maybe turn it in at the VISA appointment and they sent it to the correct adjudicating office. Problem is K VISA has expiration dates so it could be issue of how long it takes for I212.

Lone I212 are also hard to followup on.

It depends on the circumstances of your case. Why were you deported? Did you enter without inspection and get caught? How many times?

yes i try to get into usa and i get cougth by border patrol and i was deported to mexico were i am now i waS IN JAIL FOR A MONTH AND THAT WAS MY SECOND TIME SO NOW I GOT 20 YEARS

I GOT A DWI IN MY FIRST DEPORTATION IS WHEN I GOT 10 YEARS THEN AFTER 8 YEARS AND A HALF TRY AGAIN BUT BAD LUCK I GET COUGTH BY INS THEN AFTER 1 MONTH IN JAIL THEN DEPORTER AGAIN BUT THIS TIME I GOT 20 YEARS I GOT MY WIFE LIVING WITH ME BUT SHE ITS SO SCARE LIVING IN MEXICO FOR THE VIOLENCE THAT WE HAVE HERE

So you were deported, and then tried to re-enter? Got caught a 2nd time and deported again?
