Actually, this thread was highjacked as I was the original poster as I posted about my legal problems 30 years ago. But thats okay as I understand that she must be stressing as well. With that being said, as well as the fact that I have learned alot in this process, the young lady with the fiancee with the legal problen involving the 11 year old, the best advise I have for her is to seek attorney representation. There are many attorneys that will at least give an initial consultation at no cost. Good luck to us all.

I really think your fine. I would ask a lawyer just to be on the safe side. But unless the conviction had to do with the crimes listed on the form I think you should be fine. Just for the future you might want to look at getting your records expunged. I know that I consulted a lawyer before I sent in my I-129F. There are tons of free immigration clinics (most catholic charities locations have one) and most lawyers will do a free consultation. So, even if you can't afford it there are options. I know you already mailed in your packet. I would try and consult with a lawyer, but honestly I think your fine. It's your fiance who has to disclose their entire criminal history (if they have one).

YOU can do your own FBI back ground check on yourself it's cheap and you will know exactly what is on your record. My friend just did one on himself for like $45.00. No one can tell you better whats on your record than the FBI. All you need to do is fill out the form and send in your finger prints.

I, like you , had a charge from 1982. Mine was for trafficking drugs. Pled under first offender , received probation. Probation ended and records were expunged. And , Yes , I was worried that I would be found ineligeable. I answered truthfully on 129 question , which was yes . I also obtained a statement from the court where this took place ton that effect , and included it with my 129 petition.I also included a brief statement saying all this . My noa 1 date was nov 16, 2010. Checked immigration web site and saw that I had no2 last friday . no hard copy yet . I think that you will be ok . Just wait . I know it is hard but you answered truthfully . good luck .
