Hey guys,

I forgot to send the check with the I-130 package that I sent. What's the best procedure to follow now ?

I would wait until the send the application back and start over again.

There's no way to send it as an addendum to the original package ?

I'm pretty sure they will send it back to you. You will have only lost a couple of days anyway. Just wait until it comes back then resubmit with the check. If you send stuff to them without a documented request from them (i.e. A letter from them), things tend to go very wrong.

No big deal...just a few days.

Well, I don't work there so I can't make any promises about the exact time frame...but it won't take too long before they realize they didn't get their money...and they do send those packages back with a letter explaining that they want the money before the will even attempt to process the package.

So they sent the application back with a notice form that it is missing the payment. They have also placed special codes along with some hand written lines at the side of some of the pages. Now my questions is that:

- Can I just take the same exact document package, enclose the check and send it to them without making any modifications ? They have also re ordered and stapled my application different from the table of contents that I submitted to them.

This thread is four days old and I presume that the OP has things under control now, but I thought I'd add in some info as I too sent a check for the wrong amount with my first I-130 submission.

My I-130 package was returned approximately 20 days after it arrived at the lock-box because I made out the cashier's check for the wrong amount. Whoops. Everything was present in the returned copy, but the papers had all been re-arranged, re-stapled, written on, and generally mucked about with. The I-130 itself had important-looking numbers scrawled on it, hastily crossed out in red pen.

The package was accompanied with two forms. One was a white form indicating that the I-130 was rejected before it had even been really processed, but that I was invited to re-petition if I fixed the indicated problem (improper check value). The other was a green form that said it should be included as a cover sheet if/when I re-petition, to expedite processing. Presumably they take pity on those of us who can't follow basic instructions!

Since there was no case number and the I-130 had never been accepted, I was concerned that if I resubmitted the messy returned copy they would be confused at their own scribbles and disorder. I decided to submit my back-up copy. Naturally I forgot to include the green form, but I received NOA1 two days after the back-up arrived at the lock-box, so I guess they correlated it with my earlier failure and expedited it despite the green sheet.

Additionally, the instructions say that the passport photos in the I-130 package have to be taken within 30 days of the date of submission of the I-130. After a 20 day delay I was concerned that the whole thing would get sent back because the pictures were out of date! (The instructions don't require it but we wrote the date they were taken on the back of the photos.) Luckily everything went fine and I had no problems.

Well, other than admitting to my wife that after months of researching and planning I messed up step 1 of the visa process.

USCIS (128 days)

January 8, 2011: Mailed Petition for Alien Relative packet to USCIS.

February 1, 2011: Received Notice of Action 1.

May 16, 2011: Received Notice of Action 2. Case handed off to NVC.

NVC (41 days)

June 24, 2011: Mailed Affidavit of Support packet to NVC.

July 12, 2011: Received checklist letter 1.

(Long delay intentional; not counted in processing time.)

October 12, 2011: Mailed Immigrant Visa packet to NVC.

October 20, 2011: Received checklist letter 2.

October 26, 2011: Mailed checklist letter response packet to NVC.

November 4, 2011: Received interview letter. Case handed off to the consulate in KL.

Consulate

November 12, 2011: Completed medical exam.

November 19, 2011: Picked up results, everything clear.

December 1, 2011: Interview - approved!

December 8, 2011: Visa in hand.

POE and beyond

February 5, 2012: POE at JFK, no problems.

February 29, 2012: Applied for and received SSN from the local SSO.

April, 2012: Applied for and received state ID at the DMV.

(Slight delay, had to redo biometrics at the local service center.)

April, 2012: Conditional green card arrived!

Removal of conditions

2014 is right around the corner...
