If k-1 got denyed, could we get married in my country( Aisa) and apply spouse visa?

Is it a faster way to apply spouse visa than fiancee visa?

Start getting impatient now~~

May 12, 2006 We sent K-1 Package

May 23, 2006 We have received NOA1

June 14, 2006 Our case had been transfered to CSC

July 3, 2006 We had received for asking more evidence

July 4, 2006 We sent back right away

July 11, 2006 They had got our REF

July 12, 2006 TOUCHED

Sep 14, 2006 TOUCHED.............finally

Sep 18, 2006 Got approved.............Yes!!

Sep 28, 2006 Received NOA2

:) Come on!. Why visa should be denied. Just follow all instructions, be aware and do your best. You went this far already. All will be just fine and dont give up. :)

And as I have heard timings is almost the same. K-3 maybe easier about evidences, harder about affidavit for support. :)

if visa is denied keep working with your senator and your lawyer untill you get it ,they never deny visa like k-1 or k-3 they give 221(g) which is not a denial,its just more time for proccessing ,so i dont think k-1 will be denied if so they will just need more proccessing because they never keep couple or fiance seprated got it?;)

It's best to find out the reason for your K-1 visa denial. If not, then the same reason could be given for the spousal visa.

And no, it's not a faster way to apply for spousal visa than a finacee visa. If that were the case, everyone would be going abroad to marry then filing for a spousal visa.

It does not seem like you have been denied. Hopefully it will not come to that. In the rare chance I am denied I will get an attorney immediately.

Judging by your timeline you got only RFE, what caused you think its denied?

ieva & carl - I believe it's just nervous energy and time weighing on Carollin's psyche. When I first began the process, I thought the same way because I wanted to cover all the bases, just in case. After I became a little more knowledgeable and comfortable with the process, my fears subsided and are practically non-existent.

Carollin - K1's are just a tad faster than K3's. Since you have begun your journey with the K1 process, hang in there and ride it out. It won't be long. If you don't have any landmines or complications that would cause your visa to be denied, then don't worry. By the by, you probably already know this, but don’t get married while you are waiting for the K1 or it will be invalid because you changed status. Cheers!!!

Is there a reason you'd get denied? If that reason would be a good enough reason to deny your K3 then I'd suggest you looking for counseling with an immigration attorney.

Otherwise just sit tight and wait to see if your RFE was enough evidence to them to put your case back on track.

A spouse visa is not faster.

Getting married will not overcome a denial.

Addressing the reason for denial is the only way to overcome a denial.

Relax, you will get an approval soon. We waited for 150 days.

Everyone will get processed at some point, give it a little more time, ok?

yeah if you follow the instructions and dont have any proplems with your documents and the forms and your legal government you will be fine. Just its taking time and its the shorter kind of visas in time. and one of wonderfull kind of visas.
