HELLO ALL,

I RECEVIED A DENIAL LETTER FOR MY FATHER'S I130 FROM TODAY :help:. (I SENT IN THE I130 FORM ALONE AND THE MONEY ORDER NOTHING ELSE) WAS I SUPPOSE TO SEND OTHER DOCUMENTS WITH THIS APPLICATION?

ALONE WITH THE DENIAL LETTER I RECEIVE AN APPEAL LETTER WHICH I HAVE TO RETURN IN 30 DAYS, THIS LETTER STATES (TILE 8, CODE OF FEDERAL REGULATIONS, PART 204.2(F) (2) STATES IN PERTINUENT PART: Evidence to support a petition for a parent. in addtion to evidence of united states citizen....the petitioner must also provide evdience of the claimed relationship.

(I DID NOT KNOW I HAD TO SEND ANY DOCUMENTS WITH I130 FORM)

MY FATHER NAME IS NOT LISTED ON MY BIRTH CERTIFICATE

I AM KINDLY ASKING FOR HELP PLZ I ONLY HAVE A FEW DAYS HELP

Yes of course you are supposed to send more than just money and the petition, You are to send proof of US citizenship as well as proof that hes your father + the other forms required.. Did you check the guides?

The fact that your father is not on your birth certificate is going to be a really hard issue to pass that he is your father.

Because fathers name is not listed on BC, consular will request DNA.

Must demonstrate that your father has been actively involved in your life, i.e school records, holidays pictures, birthday celebration pictures

You maybe required to create a timeline with evidences to support.

Here is a link to the PDF for I-130.

Please do not take offense to anything being said here, but you really need to have a crash course on the instructions. Read read and read again... so you can see for yourself. Then you can ask better questions. Any of these Visa processes are extremely laden with paperwork. It is imperative to understand the best that you can everything that is required. Maybe some Sr members can point you to some better guides.

I hope everything works out for you..

Take enough time to read the instructions for the I-130 form as well as the VisaJourney Guide (linked in the prior post). If you are still unsure ask someone else (family, friend, associate) to help you with them. It seems that you missed a lot of what was needed to accompany the I-130 petition.

NO I HAVE MY MOTHER'S LAST NAME

You can always refile with all of the required documentation and evidence. All you will be out of is the filing fee for this petition. It's not the end of the world, just start over and do it correctly this time. You already know what will be the biggest huddle you will have to conquer, and that is 99.2% proof that he is your father.

Do not do the DNA until the consular request it, they will tell you how and when. At the USCIS level, you should have pictures, school records, baptism records, letters from those who can attest to the fact that he has always acted in the role as your natural father, for most/all of your life. Do not do the DNA until the consular request it, they will tell you how and when. At the USCIS level, you should have pictures, school records, baptism records, letters from those who can attest to the fact that he has always acted in the role as your natural father, for most/all of your life. Make sure family has no hidden skeletons in the closet concerning this.

Send in everything else but the DNA test results, the embassy will be requiring you to do one and they are ONLY going to accept it if the results are sent directly to them from an approved lab facility. You do not want to spent $700.00 twice.

You can do it on your own, but please be advise that the embassy will only be accepting sterile results.

you've got good advice here.

Your I-130 petition is still alive. You have 30 days to keep it alive. In order to do so, you need to get supporting documentation out that:

1) you are a US citizen. Easy: send a copy of your US passport or Certificate of Naturalization

2) your dad is indeed your dad. Obviously, you don't have time to do the DNA thingi done. But you can collect whatever you have and mail it in. Most likely they will ask for DNA proof later, as your dad isn't named on your birth certificate and you don't share your family name, but at least you need to keep the ball rolling and not drop it now.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . .
