Hello.I am from Serbia and I am in USA on b1/b2 visa from may 11, 2010.I have already extended my visa after 6 months,and now I have left only one month to leave the country(they extendem my visa for next 5 months).I wonder will I get new I94 if I go in Mexico?Will I get another 6 or few months?I gave birth here one month ago, so my doughter is US citizen.I am not married here.Is it enough just to leave the conutry to get new I94?Thank you.

Is there any way I can get green card because of my doughter?What do you sugest me to do?

Border hopping USED to be a way to refresh an I 94. But now days it doesn't work. Electronic records will show that you have already spent more time than most people are allowed to in the US. Having a US born child does not gain you permission to stay. Your child will be able to petition you at the age of 21 but not until then. You can leave with the child or leave the child in the US and leave on your own. You will not be able to extend your visa any further.

This will not be over quickly. You will not enjoy this.

OMG :(

So, there is no way I can extend my visa again?You can do it only once?What If I leave the country, and travel in Serbia to my home, stay for 3 months...will I be able to refresh my I94 when I come back in US.I have multi-entry visa for 3 years.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am not married at all, but my boyfriend is permanent resident.I plan to be few months here, few months in Serbia...for next 3 years or so.Can I refresh my I94 beeing in Serbia for few months?And what to do with a baby's passport?How to explain that?

I would not try to re enter after a reasonable gap, they may well suspect that you are living here.

Does the child have a Serbian passport?

Probably best if you leave on time and your b/f bring the baby when the baby has a passport.

Sorry, I should not have assumed.

A visitor's visa is to visit- you effectively live in the USA. You will need to stay outside of the US more time than inside, and thus I would not expect you to be allowed back in with your B visa for about a year. If you want to stay longer in the US, you should look at other options (F1 student visa maybe, or work visas).

Even if you are able to obtain the baby's passport before you leave, there will be potentially problem when you try to re-enter, you will have a newborn who has a US passport and you will have a visitor visa, the CBP will probably look at this as if you do have reason to have immigration intent. The question that will be asked of you, where does the baby's father now reside, and when you state the US the chance is raise to a 95% risk factor that you will be denied entry.

Having given birth to your daughter in the US does not grant you a path to residency or citizenship, automatically... I guess when your daughter is able she could petition you by filling the I-130, yet your overstay would be questioned. As other VJ posters have mentioned, you may not be granted automatic re-entry if you leave the country...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

No she doesn't have.We didn't have time yet to make her serboan passport...it was much important to make her US passport...but now I see..maybe it colud be better idea,'cause I think we woludn't wait for serbina passport so long as for US one
