It's been 3,5 month since we filed the I-129F and today we both lost it. Waiting game is not for us and we decided not to wait anymore. After reviewing the options available to us we decided to stay on different continents and no longer torture each other with painful questions for which neither of us have answers.

Yay! my first post! I agree if you give up after only 3 and a half months, then it wasn't meant to be. LDR is a waiting game by itself, ad in long wait times for k1 processing and your going to definitely be sitting on your hands quite a bit. I wish I could be waiting 3 and half months at this point. I have been working on a divorce from my ex since oct 2009. She has done everything she can to make it take longer even tho there is nothing to argue over. I have most of my petition ready with a big blank spot for "date of divorce". I wonder if it will look suspicious to have k1 mailed off the day of or day after i'm divorced. :o)

Well, at least you both lost it and you were in agreement about giving up. Best wishes to you both!

It could be a red flag depending on the embassy where the beneficiary will interview. Make sure though that the divorce is final and you have the divorce decree and send a copy with your packet.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

This is precisely why I'm choosing to view this drawn-out K-1 process with some stoicism. The USCIS could be providing us (inadvertently that is, I'm sure) with an opportunity for scoping the depth of our commitment to be with the other person, especially someone we've known only for a short time.

Provided of course that we use the time wisely :unsure: It's all too easy to be focused on the process that sometimes the dynamics of the relationship itself tend to take a backseat.

NO not at all as you have no jurisdiction over how long the divorce can take and you are separated anyways and that is for longer than 12 months. My divorce was final 22nd Feb 2010 filed day after no problem.

Divorced !st November 2012.

I think it is possible that you could get asked about the timing.

I'd have these dates prepared:

1. Date of separation. (probably stated in your divorce papers)

2. Date divorce filed. (definitely in your divorce papers)

3. Date of actual divorce.

That way you can show that you were actually separated during that time period.

Also, depending on your state, you may not be able to file right after the divorce. You may need a week or so to get a certified copy of the divorce decree. (Do not try to send just what your lawyer gives you the day of the divorce, it isn't the right document.)

To the OP:

I'm sorry to hear that your journey is over. This has been one of the hardest times of my life, I will freely admit, and it is certainly a test of our relationship. However, you push through and follow what you believe in most.

You received NOA1 in December and now it's quits? Obviously your relationship wasn't that strong and it is best to end it now because this little waiting is the least (trust me, the least) of the pressures that your relationship would have had to endure.

Many folks are not cut out for international relationships. Good luck to both of you.
