Next step after fiance arrival in USA

Hi All,

After my My fiance passed her interview and visa and plane ticket is in hand she will be here at the end of the month. We will get married a month after she comes here and then we will start the process of applied for SS card and AOS.

I am just little confused on adjust of status, will we be called in for an interview after we file for AOS or this interview will take place after two years to extend her green card then. Detail advise would be very much appreciated.

Not all couples are called for an interview for AOS...It is kind of like the luck of the draw or 50/50 chance.....Good Luck :thumbs:

It depends - some people get called for interview at the time of AOS (the issuance of the conditional 2 year green card) and some don't.

There doesn't appear to be a logic as to who is picked and who isn't - you'll just have to file and wait and see. Good luck :)

There's an AOS thread in my signature that will help you.

Basically there is a 50/50 chance that you will need an interview to get the GC (depends on your file, depends on your local office.. no way to know for sure whether you'll get one or not). It will be a 2 year conditional greencard and after 2 years (minus 90 days) from getting the greencard, you'll need to file for "Removal of Conditions" (ROC) to get the 10 year greencard.

I've read that if you don't get an AOS interview you are more likely to get an ROC interview and vice versa if you don't have an AOS interview. Can't tell you if that's true though. I don't need to ROC till April 2012.

I suggest the next step would be to wait 10 days after arriving in the USA and go to the SSA local office and get your SSN card. You don't have to wait 10 days though but different SSA office might not know the new procedure. With different SSA local office interpreting the K1 visa holder and getting married, some SSA local office are denying the applicant for SSN card. To avoid SSA local office confusion regarding married K-1 visa holders, wait 10 days after arriving in the USA and apply for the SSN card.
