Timeline

Hi everyone i'm new in this post, I have a problem my fiance will have his appointment soon at the consulate for his fiance visa. He has been deported twice has anyone been aproved with a waiver in a situation like that. Please help me out and let me know if someone has face this.

I have not seen a post like that.

Normally one deportation may result in a 3 or 10 year bar, a second results in a lifetime bar.

Good luck with the waiver.

Still, more details are needed. Was he ordered to leave or did he leave of his own accord in 2003? There is a big difference between a voluntary departure as ordered by a judge, simply leaving on your own, and a deportation. A deportation carries a separate ban for being removed at the governement's expense. A voluntary departure as ordered by a judge or on his own carries no extra ban.

Your problem is not the removal. The problem is that anytime you accrue more than 365 days of unlawful presence post april 1997 and then subsequently enter without inspection, you incur a lifetime ban that is not waiveable until 10 years have spent outside of the US. This situation also arises when someone enters without inspection after a deporation. The codes for this in the INA are 2129ci and 2129cii There is currently no way around this law.

I too suggest that you head over to I2us. There is a support club for what they call 9c'ers. There are also some recommended lawyers on that site that you may wish to consult with. You can also ask Laurel Scott your question on her free weekly chat Wednesdays at 11am CST Her site is www.scottimmigration.net Make your question brief but detailed and make sure you clarify what you mean by "voluntary deporation."
