Question about Deportation

Hello. This question just popped out of my head, and I thought of seeking reply from those with an idea. A person may be overstaying but how does one actually get deported? Who is considered under deportation? Does a tourist who overstays with a tourist visa can actually get deported? how? does he/she receives a letter, etc? Thanks so much.

It's easy to recognize: if you find yourself in handcuffs, spending a few nights in a cold prison cell with a free standing toilet and then get pushed into a white van and driven to the airport, where you get escorted to the plane before they take off the handcuffs, you have been deported. Don't worry about letters . . .

People don't get deport for overstaying unless you did something illegal and get caught by police. If u thinking not to leave prior your visa expiration date, soon or later u'll get caught, because the US system work by social security number. Since u staying illegal here then you don't have SS#, that mean later when you are sick and need to go somewhere like hospital they will find out about you. The government will not held any responsible for you either you die or alive. Once u considering leaving AFTER your visa expired, the airport custom will scan your passport, there you go, u arrived on a tourist visa and overstaying. The penalties you are receiving depends on how long you overstayed and they will apply an appropriate ban to you. Don't even think about applying another visa, because u'll be ban normally from 5-10 years.

Passports are not scanned when departing the USA when upon entering the foreign country which have no access to US based systems except for Canada it seems. The ban varies based on the time the person overstayed his/her visa.

That was helpful thank you. I asked that in relation to my situation actually. Coz I'm now married to an American citizen and we're consolidating the requirements for my adjustment of status. I was just thinking like what if someone would call USCIS to tell that I'm already overstaying for months now actually, so would that affect my application in the future. Thanks hoping for your replies.

Not quite. Your Application may not be affected just by them calling but could case can impact maybe at the interview stage if they were advised of a marriage of convenience...

If things were to take a turn to deportation then spouse probably could prove hardship to stop/slow the process.

Why are you worried? Have you every been under immigration proceedings?

Oh no, I don't think so coz I haven't been in a court to respond to any proceeding. That was why I asked coz I left my relative's house already and I don't know if anyone has actually called USCIS enough to cause them to search or call that place. My marriage with my husband is not for convenience, it is a true marriage. Truth is, my relatives did not approve of my marriage with my husband in the first place and it has caused them to talk ###### (pardon the use of the word) about us. So, I'm just worried they may do something stupid like that. Any thoughts? Would USCIS even entertain things like that from disgruntling relatives? Many thanks.

If you have overstayed you are out of status and subject to deportation. Whilest they may not make a big effort to apprehend and detain you pending legal proceedings, if you were easily available and they had nothing better to do you may find yourself in the situation Bob described. And no, they do not send mail or courtesy noticed to persons who are out of status.

Best to file for AOS ASAP as then if you do find yourself in said situation usually they will delay proceedings until your AOS is approved or denied.

This isn't necessarily true. I had a friend whose wife got detained and deported for going and picking up a shipment from her home country at the airport. She didn't do anything illegal, and wasn't apprehended by the police, her name just came up at some point during the shipping through customs.

I read from another thread that if your marriage took place prior to a deportation proceeding, then it will not affect your application for AOS. So, I was thinking even if my disgruntled relatives call USCIS or something, it will not have an impact. Guys, I'm just worried about my evil relatives as I mentioned in the previous messages. lol.

Well?get busy and file for AOS ASAP, like others said. Be worried about getting stuff together for your own AOS application - stuff that you CAN control - other than being worried about what other people may do to you. You know , there is a saying about things that you can/can't change and about being able to make the difference between those 2.
