Depending on the outcome on our NOA2 (whenever it gets here), Ahmed and I are thinking of bailing on the K-1 and starting over on a DCF. Any thoughts or suggestions? Anyone else contemplated this craziness? Aside from starting over and paying a new fee, what are the downsides? Ive read the DCF guides here, searched the forums, and a few other sites, but I figured it was time for some good 'ol fashioned VJ experience. Any ideas or suggestions are appreciated.

I would hang in there a little longer, we are seeing K1 aprouvals from CSC that were NOA1 march and April.

Not sure how easy that would be, especially in Morrocco as it looks as if they dont accept non resident US citizen DCF's under normal circumstances......

6/01/06 - Redirected to CSC

6/14/06 - CSC e-mailed confirmation on the reciept of file

6/23/06 - They they sent the IMBRA RFE

7/03/06 - The emailed that the IMBRA RFE went out on 6/23/06

7/03/06 - I received IMBRA RFE

7/05/06 - Touched

7/06/06 - Delivery Confirmation from the Post Office RFE recieved

Just be certain to check with the US Embassy/Consulate in your finace's country.

I know that the US Embassy in the Dominican Republic doesn't do them ..... and I'm sure that this is likely the case in other countries as well.

We are considering that option also for the moment. We're waiting for an answer from the embassy on the residency requirements for the U.S. citizen.

We wouldn't really wait for the NOA2 anymore because I agree, once you have the NOA, it might not be that interesting anymore to abandon the K-1 route.

But, on the other hand, DCF seems to have other advantages, such as faster work authorization, no?

Please note that that list is not entirely accurate. I recommend the DCF Guide here at VJ for a better way to find out if your country will take a DCF petition.

Just be certain to check with the US Embassy/Consulate in your finace's country.

I know that the US Embassy in the Dominican Republic doesn't do them ..... and I'm sure that this is likely the case in other countries as well.

The DR will do them, but you still have to get in line for the interview queue---running over one year there now, I hear.

Also, some countries have specific residency requirements, while others don't mind if the US is resident in the US.

Considering it too. But if you're going to wait for NOA2 I don't see any advantage in DCF. The time saved is the time not waiting in a USCIS queue.

Check your embassy requirements before making a decision - once you get married you can't go back!

The advantages in a DCF are more than cutting the petition queue, IMO. The resulting visa is the complete package, and gets the immigrant to PR status much more quickly.

We are considering that option also for the moment. We're waiting for an answer from the embassy on the residency requirements for the U.S. citizen.

Woohoo---looks very good from Brussles' website---did the USC call them? That would be the recommended way, if you can get through to a human!

One thing to consider when you're looking at going the DCF route is how it will effect that transition once ya'll move back to the States. Will you have a job waiting, a means of supporting the new immigrant, a place to live? How much more difficult will it be for you both to come home and have to scramble to get everything set up?

I know at least in my situation, with an arab husband, it was essential that I had things set up here so I could ease him into life in the US. I could focus on getting him settled and not have to worry about getting myself settled in again too.

So true!! Having lived in my fiance's country for one year, and then returning to the US, I would absolutely caution about trying to re-establish in the US.

You can't get a job without a telephone number and a place to live, and you can't get a telephone number and place to live without a job (not to mention all of the lump sum cash deposits that you will need). Additionally, auto insurance companies will charge close to an additional 50% for not having had recent coverage. And then there's also the fact that you still have to prove your financial stability in US dollars ... which is hard to do from another country.

I had thought about these things, too. But my company will hold my job for me, so Im not too worried about that. But having a place to live is a tad more complicated. Ive been living with my aunt and uncle for the last year and a half, and if I leave I would be leaving most of my effects in their care and still receiving mail at their house. Upon return to the U.S. we would need our own digs ASAP, and I havent yet figured out how to accomplish that while overseas. Alot to consider. I guess the main reason we are considering the DCF is because being apart is really hell on our relationship. We try so hard to be strong and tough it out, but its so discouraging sometimes.

Apologies, Tim--you may have even already told me that before (oops).

So even USCs resident in the DR "for real" (like a year+) are not eligible to file I-130 at the Consulate?

Or it's just not available for the non-resident USCs?
