Hi. My story first, quickly.

Me and my ex-fiancé went through the K-1 process to the interview step. We had a falling out, I withdrew the K-1 and the file was returned to USCIS In December 2010. I sent USCIS a confirmation withdrawal letter which they have already received.

When I filed the K-1 last year, well, the bottom line is, we just were not ready at that time.

We have since reconciled and want to start the k-1 again. We want to see each other before I begin the K-1 journey again. But due to some ailments I suffer I can not travel to China to visit her at this time, nor can I live there for an extended period of time beyond 2 weeks. So she wants to come visit me here on a B2 visitor visa.

Also, she mentioned that when I travel to China in the future, we can get married there and do a CR-1. I told her that due to my ailments, I can not live in China. She said an extended stay by me in China is not required for a CR-1

So my 2 question is are these:

1. What is a good write up for me to send her in a letter inviting her to visit me so she can give this letter to the embassy for her b2 visa application?

2. Which is the best fit for me? K-1 again, or marry in China and do a CR-1?

But the most important reason for this post is I really need help to write up a proper invite letter for her to help insure she gets the b2 approved.

Thanks for your help and my apologies if these questions are redundant from other posters.

October 30, 2017:  Received email that Oath ceremony has been scheduled, letter to follow with date and other info. 

                                  USCIS case status updated w/same message as email.

November 2, 2017:  Oath ceremony letter received scheduled for Nov. 7, 2017.

November 7, 2017:  Oath Ceremony, Certificate of U.S. Naturalization in hand!!!

Well when writing the "invitation letter" you just make reference to being a US. Citizen and that you are inviting your "friend" to visit you in the US You can say that you're unable to travel there however it might raise eye brows for a B1/B2 visa anyhow. You state in the letter that you will be responsible for her whereabouts.. financial state etc so she would not become a public charge.

**** Seems to be though that she just wants to be married and get in the US> K-1 is fine (just more expensive, CR-1 is cool less expensive and takes just a little but longer time. You will have to go to the Adjustment of Status with USCIS with the CR-1 she will get the green card mailed to her after a few weeks in the country.

Well when writing the "invitation letter" you just make reference to being a US. Citizen and that you are inviting your "friend" to visit you in the US You can say that you're unable to travel there however it might raise eye brows for a B1/B2 visa anyhow. Thanks for your reply and that link. So then she is correct, for a cr-1 I can just go there, slam on the ring, marry her, then do the I-130? We've been in a relationship (good or bad) since July 2009. The k-1 was tons of stress for us. She would like to just get married and get over here. I feel the same. of course you're welcome. you can see her, marry her then mail the I-130 whenever you please.. same day.. next day etc. i'm glad you're good just wanna make sure you know what you're doing. Now its really goood she would use the b1/b2 visa for its intended use - to visit. it maybe difficult for her to get a tourist visa...why..? because she already showed the intent to migrate thru a petition that was filed but you should still try.

It will be near impossible for her to get a tourist visa- she is a single, (young?) Chinese woman who is visiting the fiance she previously had a K1 with.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

mortgage on a house or two.

to 'show a friend' of opposite gender in USA,

IMO

is the greatest killer you can put forth into her B2 tourist visa package.

Going Forward -

You can get married in China in 5 minutes at the local (city of her hukou registration) marriage registry office - is no ceremony there - just sign both names, take some photos, get two red marriage books ,

but prior must have (on you) the 'certificate of single' - I gots mine done at the USEmbassy in BeiJing (Affadavit of Single Status) - Chengdu, Shenyang, ShangHai does em also (no clue about GUZ) then we took this document (again, it's in English) to the marriage registry office - they told us exactly which 'English to Chinese' Translation/Notary Office to go to (we did that) and then we were allowed to get married.

YMMV, greatly, but - if you plan ahead, you can get married within 3 days of landing in China.

Nota Bene: 'getting married' is never the same as 'have a wedding party', at all.

She insists she can't do the b2 because:

1. If she has my letter, she will be denied.

She has already been to Australia and New Zealand, but always the U.S. is a road block.

#######? It seems like convicted killers in prison have an easier time to gain conjugal visits than it is for a law abiding citizen to get a fiancee to visit me here. What is going on here?

All things considered, it looks like I may opt to go to China and marry her there, then bring her back on a I-130. Does anybody know a way she can get here on a B2? Are there sad stories about bringing a spouse from China to USA on a I-130 (ie. high failure rate). We just want to get married.

I will go with most response - for her getting a B2 would be nearly impossible. She is single has shown intent to immigrate in past she will have to come up with really good reason as to why she should be getting a B2. Letter from u would not be enough, if the consulates started accepting such letters as the only bases then any tom, ####### and harry can write letter and country would be flooded with immigrants.

It was you guys who screwed up on K1 so dont go on ranting about prisoners having more right then u.

Also to let u know I dont think there is much diff in paperwork for k1 or cr1 - you and her will still have to go thru the paper work and wait for various got agency to their work.

Darnell, this is too hard on us. We've decided that I will go to China and marry her and bring her in on a I-130. So I guess I will see you on the CR-1 forum like, oh maybe March. I've noted your input on the papers needed when I marry her over there. Thanks to all to replied and see you on the other board, soon.

Darnell, since you've been through this in China, if you've any more tips, please chime in. Thanks. Time to go shopping for a ring :yes:
