Approved! Received passport in the mail yesterday.

After all that waiting, the interview took about 3 minutes! How did you meet / what is your fiancee doing at the moment / when do you plan on getting married - and that was it. Approved. Really pleasant and easy.

Should be heading over just before Thanksgiving. Best of luck to anyone with weddings coming up :thumbs:

Hi everyone,

Congrats to all newly weds and recent K1 approvals.

Recently filed for our AOS in Oct. and today a I-797C notice was in mail stating our case was sent to USCIS Office in California for processing to speed up processing. Its says under notice type: TRANSFER NOTICE. Has anyone else had this. Also we live in Ohio and to have an interview that far is going to cost a fortune for traveling/lodging ect. and is maybe not possible to do interview if its scheduled in Dec./Jan. because my due date is Jan 17, 2012 but my doctors have put me on bedrest already and expect me to deliver in late dec. I really hope we dont have to travel or that we are processed without an interview.

Hi Jen, wow, late repply!! I'm sure you probably had some news by now. I recently sent AOS and from what I've read, mostly, when they send your case to California, they don't even ask for an interview, they just send you your Green Card. And if they decide you do need an interview they send it back to the NBC which means you would have your interview in the office near you.

The transfer is usually a good sign and you might get lucky...mine was transferred to CSC on October 31, so like a week before yours and just got email and text yesterday stating they have ordered card production for my green card. A little after a month after the transfer, no interview. So who know, you could get your GC approved next week too.

How long did they tell you it will take for them to process it and for the couple to receive the expedited marriage certificate? We are thinking of getting married in Hawaii, but it would be only a couple weeks before my I-94 expires so I don't know if we should do that. I called them and they said that in addition to pay for the expedite, we could call Honolulu and say that we need it extra fast for immigration reasons and that they would help us out. Did you guys try that?

Ahhhh and most importantly - congrats on the marriage!!!

We got married in Hawaii too... on Oct. 23rd... we didn't get our licence in the mail until first week of December. It was a long wait but now I have my SSN and will be doing the drivers licence and bank account thing next. Still haven't filed AOS, although working on the paperwork now.

Hey fellow January filers... hope this finds you all well for the holidays!

I have a question(s) I need some help with. We haven't filed the AOS yet, we are working on it now but in the meantime my I-94 expires next week and I want/need to fly within the US first week of February. How do I go about changing the date on my I-94 as I have fulfilled the date requirement by getting married within the 90 days? Can they change the expiry date on my visa if we can't get the AOS paperwork filed before it expires?

Hey Janis!

We ended up getting married in Virginia and we are planning to go to Hawaii on a honeymoon later on in the spring, after things have settled down a bit. We actually got copies of our Marriage Certificate the very same day we got married, so we are thankfully that is taken care of :-)

We still haven't filed for AOS either, and my I-94 expires this Thursday (!!!). Basically if you don't file before it expires, you will be (sort of) out-of-status until you send the papers out and receive your NOA1 for your application, so between the expiration date of your I-94 and having the paper version of your NOA1 in hand, you shouldn't travel anywhere where you will need to show your passport. This is because you have no way of proving that you are in fact in the country legally, so they actually have the right to detain you until they have confirmed that you are here legally. Of course that's the very worst case scenario and I imagine almost never happens :D

As long as you have your NOA1 before you travel in February, you will be fine. Just remember to take it with you on your trip!

Travel within the US requires a government issued ID in which the name on it matches the name on the ticket. If you are using your home country passport as your ID, just remove the I-94 and keep it in a safe place. Since you have fulfilled the requirements of the K-1 visa the expiry date on the I-94 is of no concern as it is going to be expired while your AOS is being processed. You can be detained by immigration people should you be in a state near Mexico, but other than that there is no problem with an expired I-94 on a K-1 visa especially if you have filed the AOS and can produce a copy of the NOA1. If you file the AP/EAD with the AOS it MAY arrive before your travels and you would have no problems--ours took 46 days from sending off the AOS package, but that was last March. I would just have a copy of the NOA1 ready just in case there are problems, but the TSA person is checking ID not immigration status on domestic flights.

Well we had our interview on 12/21/11 and we were approved! We were both saying it would be very ironic if the green card arrives on 1/6/12 because that will be exactly one year to the day that we started this whole process. Anyway I just figured I would post an update as we all have been together going through this for the past year! Best wishes to everyone and a happy New Year too! We'll be popping in and out a lot. Still got ROC to do in 2 years :crying:
