Hi,

When we filled out our I-129f we listed my fiance's 2 kids. When we the our NOA1 the kids were not listed as beneficiaries and the country of origin, the Philippines, was not listed on the form. Should we be concerned?

I looked at all of the guides and have posted a question here before about K2 process but didn't get any answers and didn't find anything that said extra forms or steps where necessary for the kids on a K2.

Should we be concerned? Should I contact the USCIS? We want to make sure that the kids are included and will get their K2s.

The kids are not beneficiaries, they're derivatives. They are not suppose to be on the NOA1. When she gets the petition approved and starts the visa application that's when she'll apply for their visas based on her eligibility. Make sense?

I thought derivatives were some kind of stock option?????

What do you mean by apply for their visa? Is it a separate process? Or can it be done in conjunction with her visa? Is there some documentation on the K2 to that I can read?

when you receive the receipt(noa1) the beneficiary is your fiancé, as long as the kids are mentioned on the forms you're fine.

the only time you will have to start filling out papers regarding the kids is when you fill out the affidat of support

1 for your fiancé and 1 for each of the kids.

but otherwise if they have been mentioned youre ok

Sure. Click on the word "Guides" at the top of any page here. Be aware of the difference between "filing a petition" and " applying for a visa". Too many people interchange the terms in error.

They will also apply for visas based on their mothers petition. Each child applies for a visa, pays the visa fees, gets a medical then has to file AOS and pay AOS fees when they arrives. The exact mathmatical formula is... K1 x (XYZ) XYZ being number of children.

Use the search function and you will find lots of info on K2s.

It's not your two cents. You basically asked a question, you did not offer an opinion which is what your "2 cents" would be related to.

As for your question, the K2 visa is derived from the K1 visa. If the K1 is not eligible, the K2 cannot exist. If the K1 is eligible then the K2 derives it's eligibility from the K1.

Derivatives in regards to stocks I would have no idea. Stocks don't interest me.

In my case the son will need almost all the same forms and paperwork for his visa. the age of the child is also a factor in what will be needed.

Ah ok. I see. The kids are 4 and 6. I will see if I can locate the fees for that age group coming from the Philippines.

Their visa application ($350) and medical exam fees will be the same as their mother. After arrival and marriage, their adjustment of status fees will be lower than their mother if all are filed together, so $720 for each child and $1070 for your then wife.

lol thanks :P . This one person writes it ALL the time. Normally I ignore it but they kept posting in this particular thread with "my 2 cents" at the end and eventually my head just exploded.
