aos package rejection notice

we sent our aos package november 19 i wonder we dont heard anything yet until today when i checked our mailbox i got package from uscis and they return all my packgace with the payment check and and a rejection notice of my i765,i131,and i485.

I485 rejection notice:

x the application / pettetion was filed on an outdates version of this form.Please resubmit your application/petition on the current version of this form with the appropriate fees to the adress listed on the bottom of this notice.

x the entire application package you filed along with any ees you submitted is being returned to you for the folloeing reason(s):

your application was submitted with a single remmitance and one or more of the application/petition were unacceptable in the package for reason specified on the related Noticed of action (formI-797).please correct the flawed application and resubmit the application package with appropriate fees and suporting documents to the address listed on the bottom of this notice.

i dont know wht this mean,this anybody here experience like this/ so its mean we need to redo it out papers pls help

Sounds like one of the forms you filed is expired. Check the expire dates at the top.

Definitely expired form(s). USCIS sure is a wise-guy to send back the whole kit-n-kaboodle and make ya pay to ship it again.

While the expiration date is of course important, the edition of the form is more important as legislation/rules change, so do the forms.

For the I-485 the most current form is dated 11/23/10. The only other editions of this form accepted are 11/08/10; 7/15/10 and 12/03/09. If the form you sent isn't one of these editions then it isn't accepted, whether it's unexpired or not. The current form expired 12/31/10 so you're definitely not using the most recent form. I filed in April and mine is the 12/03/09 edition... so what form exactly did you file??

Please also be aware that the current price for AOS is $1070. that is if you're filing based on a K visa. What visa are you adjusting from?

my form will expire 2011 and i didnt notice tht the I864 was expired october 2010 i dnt really know whts the problem if its the form?i made the payment a check to department of homeland security 1010 dollars becoz i sent my application b4 23 im just really worried

It doesn't matter WHEN the form expired, what EDITION is the form? THAT matters.

Yes there is a new I-864 now so you might need a new one of that. Check the EDITION of the form against those currently accepted and it might still be okay.

You will need to pay the new fee of $1070 for AOS. One cheque is fine.

Again, doesn't matter when the form EXPIRES. It matters what EDITION it is.

Go to the USCIS website. Download the I-485 form from their website: http://www.uscis.gov...00045f3d6a1RCRD

Download the I-864 form from their website: http://www.uscis.gov...00045f3d6a1RCRD

These will be the correct, most up to date forms. Check the edition number on the forms. If either edition number is different than is on the forms you downloaded, check theUSCIS website to see what editions of the form they will accept. If the form you have filled out is not listed, then re-do the form that is different using the new form you just downloaded. (I suspect that it is because the I-864 form was expired that they could not accept your whole application.)

Put your AOS application package together with the new form(s) but re-use all of the other items you already submitted. You will need to send in a new cheque since the fee has gone up. It is now $1070. One cheque is fine.

Make copies of your new forms (and if you have not copied everything else before, photocopy it now as well). Send it back to the address they list on the bottom of your notice and make sure you get some sort of tracking system put on your package so you will know when it arrives.

and also some question on our i864 we only include w-2 for tax statement is tht be good?

If your I-485 form is not an accepted edition then yes, they will reject the entire package and that's why they did.

Re the I-864, you need to send tax returns AND w2s, 1099s and scheduled or just IRS transcripts. W2's alone are not good enough.

Did you use the forms shown on the example forms here on visajourney? I just realized I did that and its out of date.. AHHHHHHH It expired on 10/31/2010 Looks like I will be getting back my package too.. So much for trying to beat the new fees hahahaha

I had the same prob - out of date I 485 - Just redo the i485 via the uscis site and send whole package back in including the rejection notice (keep a copy for yourself) and then all should be well.

They will mark every page with writing down the side. Don't worry about it just send it all back with new form It would do you good though to make sure all the forms are current though before sending again. Just incase...
