Well... It's done. It's in the mail. My husband and I sent it out a few hours ago.

Now, I know I've asked this before, and no, I don't have any specific reasons to think that we'll be denied, but IF we were, what are the consequences? I am not on a VWP, I am from Canada. I simply have a major overstay. What would be our options?

Also, has anyone made a November Filer post yet? :P

Adjustment of Status

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done

In this case just hope for the best! My packet went out yesterday! YAY us!! :) I'm excited to because its been a long time coming. And finally, its been sent! Hope time flies by! Good luck, everything should be fine :)

12/6/2010- Received RFE to prove we meet the 125% of the poverty line. (Currently waiting to file taxes and send this information in.)

12/25/2010- Received Biometrics letter dated 12.21.2010 for Appt 1/18/2011

1/6/2011- Successful Walk-In Biometrics

2/17/2011- Responded to RFE

3/10/2011- Received email that Work Permit card production has been ordered

In response to this question IF you were denied and had an overstay of 180 days it would be a 3 year ban and an overstay of 365 days is a 10 year ban.

You can have your spouse file waivers for you but i hear this can be a difficult process.

So dont even think about this im sure your process will go smoothly and congratulations on getting your package sent off :dance:

In response to this question IF you were denied and had an overstay of 180 days it would be a 3 year ban and an overstay of 365 days is a 10 year ban.

Yes but Kitty would get a lengthy appeals process (as far as I understand canadian visitor is same as B2 without needing to apply) which could last years. She could appear before a judge and plead her case and submit further evidence of her marriage etc. But seriously, I really don't think it will come to that. /does the relaxing dance.

Since the documents left my hands yesterday, I have had the same mental exercise going on over and over... It goes like this;

"Oh man, Finally! --> Hope I didn't forget anything. --> I probably forgot something. --> I probably wrote something wrong! --> They're going to deny us! --> Why? Why would they deny us?! --> Err... good question; no criminal record, no drug use, no anything. I really don't see what would make them deny us. --> Repeat!!!"
