Hey Vjers well now I have a question but I think I made a mistake anyways. Yesterday I got my NOA1 for AOS and EAD, Today I got a rejected notice for AP.

First of all they spelt my last name wrong, Then the reasons are--

x- the cheque amount is incorrect or not provided. the correct filing fee is $305 Please resubmit application with appropriate fee to the address listed at bottom of notice.

x- Based on box you checked in part 2 you must file at a different BCIS location. Please submit to yadyaydayda

It says===== If I have filed successfully with form I-485 on or after July 30 2007 you can re file this form with no fee.

In part 2 I have to admit I was not sure what to tick and ticked the 1st box (a) but now I look at it more I think I should have done box (d) == am applying to allow me to return to US after temporary foreign travel.

OOPS I think I made a blunder not that I am worried as I am not going anywhere before GC anyways it was just in case my husband got deployed to Saudi for his work .

Should I just redo it again and send the copy of my AOS receipt which it says to send with? It's no real hassle as we don't know when my hubbie or if he will get this job but I applied just in case.

Selecting the wrong application type probably caused all of your problems. Unless you'll have an urgent need to travel, I wouldn't bother filing a corrected form. There's a reasonable chance you'll get your green card before it's approved.

You are correct there is no fee and also correct that you should re-send it (ticking the right box :P) with a copy of NOA1 for AOS (if you choose to re-send that is)

Don't worry about it filing it in wrong or anything, sometimes it just happens. Should have seen my G-325A when I filed for K1 :S Luckily I caught it before Tony submitted it but it was AFTER I mailed it to him so I was forced to re-mail him a new one (express post too), then make sure he sent the "proper" one instead of the faulty one. All the dates of employment were completely off :S it just happens... so no stress :) Just fix it and re-send :D

The only reason I WOULD bother is some GC are taking 6 months, some more. Sometimes ####### happens and I personally would prefer to have the AP in hand "just in case". The fact that it was denied shows they were at least processing, so I would think it shouldn't take too long.

Up to you honestly but you don't lose anything I would think (maybe postage and printing costs) to give it a go. :)

I'm with Vanessa. If they have your AP filing already, and something happens and you need to expedite it, then it's easier to expedite an already pending AP than to try to apply for one fresh in an urgent situation. The last thing you want to be doing is running around printing out forms and getting passport photos in a hurry!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

I'm with Vanessa. If they have your AP filing already, and something happens and you need to expedite it, then it's easier to expedite an already pending AP than to try to apply for one fresh in an urgent situation. The last thing you want to be doing is running around printing out forms and getting passport photos in a hurry!

Yeah am with you on that one Nik I resent it this morning with the right box ticked lol and copy of I-485 receipt so hopefully they will be happy with that.

Re sent my I-131 Ap and got it back today all received and processing no worries. Now just waiting for new Biometrics appointment. LOL
