From I-130 Question 14 with Visa E2

Hello everyone,

Doing the whole process by myself, I believe it is a good idea to register as I am afraid I will have a bunch of question...

Here is the first one:

I moved here in the US under a E2 (and still working for the company how did the Visa for me)visa and recently got married with a US Citizen.

Regarding Form I-130 Part C Question 14:

If your relative is currently in the US, he arrived as (a student, a visitor, stowaway etc.): What should I put there? As a worker? As a Visa E2 holder? Or without inspection (I travelled abroad several times since I am here...)

I spent hours on different forums and was not able to find a proper answers....

12/2009 - Relocation in Big Apple :)

06/2010 - Mariage in France.

11/2010 - Assembly of package (I-130, I-485, I-765, I-131).

11/22/10 - package sent to Chicago (FedEx/Overnight.

11/23/10 - Package delivered to USCIS at 10:18 am.

12/08/10 - Received Rejection Notice of the package for incorrect fees.

12/09/10 - Corrected package sent again to Chicago (Fedex Overnight).

12/10/10 - Package delivered to USCIS at 10:08 am.

12/14/10 - Received emails/texts notifications of acceptance from USCIS.

12/20/10 - NOA1 received for I-130, I-485, I-765 and I-131(hard copies).

01/03/11 - Appointment Notice received - Biometrics appointment set for the 01/25.

01/25/11 - Biometrics done.

02/16/11 - Received Email: EAD in production, Post decision/Approval for AP.

02/26/11 - Received EAD/AP Card

03/28/11 - Interview notification received by email. Interview set for the 05/03.

i'd say certainly NOT without inspection because that means you entered illegally. But you had a visa and I guess everytime you re-entered the US after your trips abroad you went through custom.

To put "as an E2 visa holder" makes sense to me if it is still valid and has multiple entries.

To Vanessa, I think I am in the right section. Indeed, if I came here under a working visa, the reason I am now entitled to have a green card is because of my wedding with a US Citizen, so for some familial reason...

Thank Bruno, I think I may eventually put: Treaty investor, which is the statut linked to an E2....

B. Information about you (US Citizen) and in front of B you have part C: information about your relative.

Question 14, just after 13 (Have your relative ever been in the US): If your relative us currently in the US, complete the following: He or She arrived as a (visitor, student etc.)

Put E2. Don't complicate it.

On the form itself, I am going to make a guess.... they put words instead of codes here "visitor, stowaway" because if they put codes (E2, K1) then a lot of people would be WAY confused and maybe just pick one for the codes that looks particularly favorable using gematria. Putting the words as an example makes the applicant answer the question truthfully and asks the question in plain english. You are one step ahead of the game... you actually know your code!

And, this is the right forum. They are confusing, but the other forum is for people adjusting FROM fiance visas, you are adjusting FROM work visa in the basis of marriage, which is the same with most people on this forum.

Ok Got it and sorry for the confusion....need to recheck everything to make sure.

But what is confusing too is that on Form I-485 they ask you what is your current status (Part 1) and again part 3 In what statut did you last enter (student, visitor, exchange visitor, crewman) So shall we put there again E-2 twice...

Ok, I think we should alway go to the easy and not to make it so complicated.....but...

Well, lets hold the joy. I am still not sure everything is as they want it, until I start getting NOAs.

It took me about 3-4 weeks. Most of that time was spent making copies, and copies, and more copies. I had to wait on some docs from Germany, and then on some translations, and so on. The forms themselves don't take much time. Thats why I ultimately decided not to pay a lawyer, because I would have still needed to gather all the documents.
