Woman shoots, kills home intruder

A homeowner shot and killed a man who broke into her Northeast Side house early Tuesday morning, police said.

Toni Hanes, 50, told police she was awakened by the sound of her bedroom door being kicked in around 3:30 a.m. in the 4800 block of Castle Path Drive, according to a police incident report.

She grabbed a handgun from under her pillow, shot once and, as the intruder fled, she continued to shoot at him, the incident report states. At one point, he said, “It's OK, it's OK. They're already calling police,” she told investigators.

Officers combing the area shortly after the shooting found the body of Guadalupe Rolando Valenzuela, 28, face down in a neighbor's yard.

Hanes told police Valenzuela had entered her house without warning a few days earlier and kissed her on the cheek, despite her commands for him to leave, the incident report states. She was not expected to face charges, police said.

Very true. However, we often see things like "this HERO (referring to the criminal who was killed) was killed by a crazy woman. She should be locked up. He was just trying to get away."

Makes no difference if he was in the house or even on the property. Once the threat has been established and you take corrective action then you are allowed to continue the action. Now if someone reloads and keeps chasing them off the property then the law in Texas frowns on that.

I will be surprised if she doesn't need a lawyer though to get through the grand jury in Houston. Many years ago it cost me thousands to hire a lawyer to get me through a Grand jury. I played golf with that lawyer not too long ago and he said that he charges a minimum 10 Grand to get even the most righteous shooting through a Grand jury now.
