K-1 Visa--My responsibility

We've completed the process, and she has the visa in hand. However, I have not pulled the trigger on bringing her over here, i.e., buying the plane ticket, because of certain things she has done and said lately. If I do not bring her over and the visa expires, am I responsible for notifying the embassy of why I didn't bring her over here, or is that simply my choice not to do so?

What if she is able to get the money and buys the plane ticket herself? She really would not need to notify you or keep you informed in any way to let you know that she is coming to the US. In fact, she could come with her K1 visa, under the assumption she will come to marry you and then possibly not see you at all and never leave the country!

If you were ever to apply for another K1 visa you would need a waiver and quite possibly demonstrate that she did not come and, if she did come, prove that she did not overstay. The burden of proof then would be on YOU. If you do not want for this to happen, call and notify in writing of your change of plans. On the other hand, are the problems serious enough to break the relationship or is it just an argument that needs some talking over and a point that needs clarification? Is there hope in dialogue?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

sounds kinda cold and heartless to take someone away from their family and life just to see if she works for you...plus saying send her back sounds like a package you're returning because it didn't fit. this is a person, no matter what her intentions are in the matter she's human and deserves to be treated so.

Agree, But if the petitioner feel like he is been played, AT ALL COST, he should stop it before it ruins both of their lives. Don't try it out. YOU MUST FEEL the marriage. If you don't see it taht way. STOP everything immediatley. I know how hard it is once you get screwed to get your normal life back plus the headache of delaing with US immigration laws. Plus the money you will spend.

It's YOUR choice to notify the embassy that you have had cold feet... You're a law abiding US Citizen, aren't you? So, do whatever that suits the law!!

obviously he doesnt love her,so going there and seeing him wouldnt do HER any good.spending a day,let alone 90 with a man youre not married to is a shame for muslims. ( it could lead to pre-marital sexual activities that are not appreciated )

bottom line is OP,keep in mind if you cancel her visa,you wont be able to change your mind about your love for her and all that stuff.but at the end of the day,canceling the visa now is much better than sending her back as a divorce

PS: i could have sworn that OP had his location set as pakistan.well if his beneficiary isnt in pakistan the ignore the first part of my statement

11/15/2010 - Touched (hopefully the approval)

11/17/2010 - NOA2 (Received hard copy 11/22/2010)

12/01/2010 - Received a letter from DOS dated 11/29/2010 stating that the petition will be forwared to USE AD within a week and that I will received the packets very soon from embassy.

01/18/2011 - Interview. APPROVED!!! No words can express how happy i am.

01/25/2011 - VISA in hand! YAY!!!

02/20/2011 - POE Chicago (O'hare)

yes you are responsible for notifying the embassy. notifying them will also spare you from problems if you decide to petition somebody again in the future.

Yeah...and its COLD AND HEARTLESS if the intending immgrant just wants to get the benefit and hail tail once he/she has it...the U.S.Citizen is also a human being...

Uh, what a taugh situation. Before cancelling the visa, could you tell us if the issues you have with your fiancee might be solved? Is there anything that can save the situation? Or is it something big and the solution is inconceivable?

After you answer all these questions and you have an open and honest conversation with your fiancee, you can make the decision. Just don't tell her you're cancelling her visa, first try to see if the relationship is for keeps or not. It's important to make a decision based on good reasons. It was a taugh process and before throwing it all away, talk to yourself and then talk to your fiancee, if that'll be needed.

If she's not the one, well, it's hard, but you're a human being too as some of us stated here.

You should definitely be solid if you go to the embassy, cancel your support of the visa, and also don't buy her a ticket over. If she's playing games now, imagine what marriage will be like. She is certainly not trustworthy. Cut losses, save headache of lifetime, bail now.

And, i do mean buying the plane ticket after deciding she is not taking advantage of him.

What happened to you guys???!!! :bonk: ,many people here at VJ.dying waiting for there visa to approve.its easy for you to say not to continue,how about us? were so prostrating to heard about our visa.Everyday wishing,hoping,praying i'm with my fiance right now,i miss him sooo much :crying: .its annoying for me someone out there its easy to put into waste all sacrifice,time and effort.whaaaaa :crying: i want my visa now and i promise to my self i will cherish him every single moment.God knows how i passing my days without him.

It obviously isn't working out for them, so what's the point in them continuing the process? They didn't do this to purposefully hold up your application.

Why try to shut down someone who is contributing something to the forum by making his story more complete AND more human? :whistle:

PLUS, he is VENTING, which typically makes humans feel better after we have been thru a taxing or trying experience.

Try it sometime, you'll like it!

I know it's hard to wait and be apart from someone you love. We're all in or have been in your situation. But you need to be understanding of other peoples' situations too. It obviously isn't working out for them, so what's the point in them continuing the process? They didn't do this to purposefully hold up your application.
