Misrepresentation

Hi,

I have read and heard about Misrepresentation... but am not sure what INS considers to be Misrepresentation? Can anyone enlighten me alot?

Misrepresentation can occur when you have submitted multiple forms and the facts in them are in conflict. Oral statements can also be construed as a misrepresentation if they conflict with others. The worse ( stupid wise ) I remember being reported here was a man from west African who used Steven on a visa application and Stephen on another. False statements can come bite you years later. Lie on your app to get here and it may pop up at your citizenship interview and make you deportable.

The legal definition of misrepresentation is "An assertion or manifestation by words or conduct that is not in accord with the facts." This means you've presented some information, you've represented that information to be truthful or factual, and it was not.

The kind of misrepresentation that can get you into hot water with immigration officials is material misrepresentation. The term material has to do with material facts, which are the facts upon which a decision is based. When you misrepresent a material fact then you are guilty of material misrepresentation. The term often quoted in immigration court decisions is "misrepresentation of a fact where, had the truth been known, the decision of the immigration officer might have been different."

Thank you all for your input... I was reading on a Immigration Website "Aliens ineligible to receive a Visa and wasn't sure...I was curious and there are really people out there that put themselves in Jeopardy for not simply being honest!

People sometimes do stupid things because they think getting to the US is the answer to all their dreams. They will submit applications for visitors visas, work visas, family visas and in their hurry they don't always provide the correct info, just whatever info they think will get them their visa. From application to application they "slip" one time saying their married, one time not and that is when they get hit with the material misrepresentation.
