Fiance forgot letter of intent in packet

Hi,

My fiance sent out the I-129F packet to the Dallas lockbox but he realized he forgot to add his Letter of Intent in the packet. Will that affect the application ? We don't want delays ...

oo That bites! I imagine he will just get an rfe for it - not a big delay; couple weeks maybe.

Yes, unfortunately that's an omission they'll likely note. It's required. So just prepare to receive an RFE, have the letter ready to go, and get the hiccup over with. Just a minor delay. Don't send it now, hoping it can be "added in" to your packet. No good. Deep breath and let it go. These things happen.

On a similar note, is it okay to just have two of the same letter with one person signing each? I found the example intent letter here and just basically wrote that with our names plugged in. is that okay or does it need to be some lengthy personalized deal?

Nope that's all it needs to be. Just plug in your names and make sure the signatures are the originals. :yes:

Unfortunately, you might get a RFE, but I thought I also read in someone's post that they, too, forgot to include a letter of intent and their petition was still approved without a RFE. So, it might depend on the adjudicator who checks your file, but even if you do get a RFE by looking at other people's timelines who got RFEs it may not necessarily delay your petition for too long.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

That's fine, we did the same.

As for the OP, you will very likely get an RFE, just get the letters ready and if you get an RFE just respond immediately and hope for the best.

DO NOT try to send the letters before you get an RFE. The RFE comes with a necessary form and special return envelope.

Depends what was sent. many couples have sent (normally unnecessary) multi-page descriptions of their "love story" which they have both signed and then "oops" forgot to enclose a "letter of intent" but their story was accepted as such.

At any rate, worst case...you get an RFE, you respond to it, life goes on. Expecting that there will not be delays is unrealistic. Delays are likely to occur at any stage and there is little you can about it except prepare as best as possible to handle it. This is a mutiyear process and a lifetime commitment, keep that in perspective when considering such things as an RFE delay for the petition.

This is what i did.. I did not include a letter of intent from either of us, but explained our relationsship and did state that we planned on getting married upon her arrival with-in 30 days ... did not rec'v an rfe for this...

while the petition requires a statement that the two plan to marry within 90 days...there really is no particular requirement for any particular wording. If the adjudicator decides it is "good enough" it is good enough.

I know people in the VSC and there is an adjudicator that speaks Russian, Lena. If anyone ever sends a petition for a Russian or Ukrainian fiancee and doesn't send a translation of her divorce certificate and DOESN'T get an RFE, it is because either Lena did the petition or someone took it to her and asked "What is this?"

This just is not carved in stone as to what is acceptable and what is not. The VJ sample letters have a LONG history of being accepted, I recommend you use them if you need to respond to an RFE

As others have said, an RFE will be sent. Just have your fiance have the Letter of Intent ready to be sent back when the time comes.

I would tend to agree that a multi-page descriptions of their relationship (AKA the EOR letter) that couples send in with the paperwork when they begin the process is probably unnecessary for initial USCIS review. IMO, I think it is very necessary to send because it will go on to the Consulate for further review prior to the interview and that is where the bar is usually set higher.

Prior to making the decision to alter course and pursue a CR-1 instead of a K1, I had written a combined LOI and EOR. Advice I had received and was planning on taking was to de-combine the LOI and EOR.

Like others have said, sometimes it just depends on the adjudicator and if they decide an lengthy EOR is as good as a simple LOI.
