Hi Everyone. My wife came into the USA 02/17/2010 on a K-1 Visa. We were married in April. We sent off the packet for AOS, AP, and EAD.

We got the AP a few weeks ago and she went home to Peru to see her family for a few weeks. She was scheduled to fly back today into New York, with a layover in Miami. I was going to be picking her up in New York at 7pm.

Well it's getting close to her departure time from Miami, and I don't think she's going to get on the flight. She only had a 2 hr layover to get her baggage, get through customs, and get to the next gate.

She called me frantically saying she was going to kill me, as there was an immense problem with her paperwork. She got the chance to call me again 30 mins later saying she's sitting in some room while they review her papers. She seemed to be convinced they said she was missing something. Details are shaky because she's not supposed to use the phone.

Anyway, she has her AP documents, our marriage certificate, her passport with expired k-1 visa, all of the notifications from USCIS of the processing of her AOS, and anything else I could think of.

Am I right to be worried? Is she missing something ?

I think it's too early to tell what's going on. Maybe just an inexperienced officer, or some problem with the computer records which she won't be able to tell you about since she's running to catch her next flight once they let her through (late).

If she didnt make it to pick up her bags and is still stuck in immigration usually they take them off the carousel and put them near the door of the 'lost baggage claim office' in that same area. She should be able to grab it from there or near that area.

That should be enough - however, what name was on the AP paperwork? Is it the same as the passport name? (maiden vs married).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I sent her with two copies. I assume that she has both.

I take that to mean original copies, not copies of an original.

OOps she just missed her flight. they took off! hopefully she can catch another flight if she gets out of immigration and find her baggage!!!!!!!!! :wow:

As for blaming you for the paperwork snafu, I hope that she can put that behind her as soon as she arrives at her POE.

Border officials frequently screw up by not seeing that what is in front of their eyes is all in order.

My first wife would always take the words of strangers, official or not and put me in the doghouse.

After too many years in the doghouse I opted for better accommodations.

Hey Everyone. Thanks for the concern.

So I got the story at long last. She was at the POE in Miami, and the man there kept asking her why she left on a K-1 visa, knowing she wouldn't be able to return. She kept telling him, NO, I didn't, I just left a couple weeks ago, with this AP document. And he said no ma'am, you left in March. You got married in March, and left immediately.

She was getting frustrated with him, because he refused to look more closely at the marriage cert and see that it was issued in March, and we were married in April. He also was convinced she left in March, although I have no idea why. He said the AP document was useless and did not care to look at it.

Another person came over, and also was convinced that she was missing something, or that we had done something wrong. They were asking for her green card, and she said she didn't have one, but it was in the works. They informed her she wouldn't be allowed to enter the country.

Finally, an hour later, they called a supervisor over, who reviewed everything and determined she was good to go. Who the heck do they have working there? Well, she missed her flight during all that time. She also went to find her baggage, and the incredibly kind, caring, sympathetic employees at the Miami airport were of little help. They said her bags were probably sent onto NY. When she asked what they meant by 'probably', they changed their tune and guaranteed her that the bags had been sent to NY.

This was around 530. American Airlines told her the next flight to NY was at 8. A couple minutes later, she heard the final boarding call for American Airlines to NY leaving in 15 minutes. She raced to the gate, and they did allow her to board.

She made it in at 830. Her bags were not on the flight, nor were they at the airport from the previous flight. The baggage associate assured us they'd arrive on the next flight at 11. They didn't. We hoped that they would arrive on the subsequent flight at 1230, and thank God they did. We drove the several hours to home, and got in at 4 am.

Her first day of college classes were today. Neither of us got out of bed. I came into work at 130. I am now sitting at my desk typing this. I work at the Social Security admin. So, we were screwed by fellow gov't employees it seems.

But anyway she's safe and sound at home, she'll try to make up what she missed on the first day of classes. Next time she travels she should have a green card. :no:
