HELLO EVERYBODY:

I AM GLAD I FOUND THIS SITE COZ I HAVE QUESTIONS ABOUT I-751 THING. ME AND MY X HUSBAND JUST MARRIED FOR 6 MONTHS AND DIDNT WORK OUT AND IT TURNS OUT TO DIVORCE PROCESS. MY 2 YEAR GREENCARD EXPIRE ON JAN. 5,2011. MY DIVORCE WAS FINAL LAST JUNE 20,2010.MY QUESTION IS CAN I FILE FOR AN I-751 ON MY OWN? SINCE WE DNT HAVE JOINT ACCOUNTS, BILLS UNDER 2 NAMES, LEASE ETC.. THE ONLY EVIDENCE THAT I CAN PROVE THAT OUR MARRIAGE IS BONAFIDE IS JUST PICTURES OF US ON THE WEDDING AND OCCASIONS..YOUR HELP IS HIGHLY APPRECIATED

Now that the divorce is final you can self-petition... you do NOT need to wait until 90 days prior to expiration to file, you can file right now.

This is correct. In fact, if USCIS finds out about the divorce then they may COMPEL you to file for removal of conditions now. The "condition" which makes your legal residence "conditional" is that you remain married to the US citizen who petitioned for you. When your marriage ended, your basis for conditional residence also ended. This doesn't mean your conditional residence automatically ended, but USCIS is required to take steps to terminate your conditional residence if they discover you are now divorced. If your marriage did not end on good terms, or if your husband made any accusations against you regarding your immigration status (for example, if he accused you of scamming him to get a green card) then he may have reported the divorce to USCIS.

Pictures alone will not be enough to prove you entered the marriage in good faith - an essential requirement for self-petitioning to remove conditions. You need to prove you and your husband actually lived together as husband and wife. Were you added to his medical insurance policy through his employer, or as beneficiary to a life insurance policy? Did you receive any mail addressed to you at the address of the home you shared with your husband? Do you have any friends or neighbors who would be willing to sign a sworn affidavit that you lived with your husband, and had a marital relationship?

The whole point is proving to the immigration officer that you entered the marriage with the intention of staying in it and not for the green card. Usually that is proved by showing joint assets and proof of living together. If you dont have those evidences but have a good reason for not having them, you can try t apply with others but you would need something to provide that your marriage was bonafide

You should file as soon as possible. Signed and notarized affidavits from friends/family, stating that you were indeed a married couple between X date and Y date, and verifying that the marriage did not work out, will help. Photos won't.

with all my heart my marriage is entered in good faith. The reason why i let him file for divorce is that he posted my private picture in porno site without my consent. Do u think u can allow urself to stay with this kind of person with no respect at all.. I really dont have those joint account, bills etc because he never done it , what can i do if he didnt...
