My fiancee arrived with the K-1 visa about a month ago. I hadnt looked at what was returned to her until today and I found that there is no I-94 form which I understand I need for AOS. In fact, they didnt return any forms at all except some of the application data. All she got was the visa stapled to her passport.

Im concerned as to what to do to start the AOS process can anyone advise me?

Hi

you need to ask for a new one( need to pay a Fee) , unless you can probe it was a POE's fault, witch is not easy.

At Vj, you can find similar stories that can guide you to solve the issue. this link show you a similar case.

Visa is not stapled, I-94 (white card) is stapled to the passport.

There's an AOS thread in my signature that has a copy of the I-94.

I agree with the PP, the VISA should already have been stuck in her passport prior to her leaving the country. The consulate did that when her K1 was approved. The i-94 (a white piece of paper) is stapled to the passport.

Thanks for replying I do see the white form stapled to the passport it Registro de Salida but nothing on it identifying it as an I-94 form. I hope this is the one!

The I-94 IS referred to as "Registro de Salida" in Spanish, but I wasn't aware that there was a Spanish version of this form. Are you sure this document is from the US government? Is there a two-color oval rubber stamp on it that says "Department of Homeland Security - US Customs and Border Protection"? If not, this may be a departure record from another country.
