OK, so that sounds very similar to what I just sent for my RFE.

But I didn't send my old passport page.. hope that's OK. They didn't ask for it :P

Did you get your RFE letter in the mail yet? Do you know what they want from you?

RFE asked for supporting documents for taxes of year 2009 - W2 only. So it was easy this one.

I sent the old passport page just in case. My ISO (international student advisor) said to send because the student visa was issued in that passport when I did the OPT EAD before.

got bio letter for June 24 :) will try to walk in tomorrow.

Congrats my dear,

Are you in Texas SweetApple08? Just noticed your hubby's USC process on your signature.

I have been a bit quiet on the forum :) Our biometrics appointment is coming up tomorrow, so I am preparing for that. We didn't do a walk-in as I read here and in other sites that our Omaha office runs a tight ship and the walk-in reject rate is high. A week or two extra doesn't matter to us anyway.

We will be bringing the kids as well, as they also got appointments for biometrics (they are 13 and 9). Does this have to do with the new green card design, or is it just a overzealous worker who sent out the appointments for minors?

I have heard of minors having to do biometrics.

I think under 14, they just do index finger printing and take a photo.

I don't think it is going to be a full biometrics/FBI background check.

My attorney just called and told me that they received my RFE. It is for my husband's most recent tax return, problem is that he did not work and didn't file taxes for either 2008 or 2009. My attorney said it would be enough to write a statement, that my husband signed, explaining that he is a full time student and did not file taxes, but they have either lost that statement or don't think it is enough. I do have a tax transcript that I offered to the attorney that says that he didn't file any taxes for 2008, of course the attorney said they didn't need that. So I'm now on hold with IRS to see if I can get one of those for 2009 too. Last time it took IRS over a month to send them though. We will probably have to go to the local IRS office and ask them for it. #######! :ranting: The IRS man on the phone told me about some letter called "verification of non-filing" but they are not available until the 15th. Oh that's my situation! So the attorney said that a statement should suffice, but you're trying to get something from IRS anyway? Is that what you're saying?

Okay, sorry, just reread. They either lost it or said it's not enough. I'm sure I'll get the same thing - I wonder if I should just try a statement or go through IRS. Urgh...

I'm sorry, I'm so stressed that maybe I confused you with what I wrote  We just sent a short statement saying that he was a full time student and did not file any taxes for 2008 or 2009 and he signed that. Our attorney said that would be enough. I had already ordered the transcripts from IRS, but we didn't send those since the attorney said we didn't need to. So today my attorney said that we should just re-send the statement, but I told her that I'm not doing that since obviously we already tried that and they sent a RFE. So I'm thinking about sending the statement again with the IRS tax transcripts for 2008 & 2009 that say "no files on record" (even though the IRS guy said he wasn't sure if Immi would accept those and we should wait until the 15th to get the letter of "Verification of non-filing" and maybe a print out from his student records that he is actually in school. I don't know.

Leigh Ann, what did you guys send? I'm so stressed out right now ....breathe in, breathe out.... :dead:

Ahh, don't stress! I'm sure you'll figure it out.

We didn't send anything about MY taxes - we just sent my parents' forms since they're the cosponsor. So, I haven't talked to my attorney at all about it. Sorry, I don't have much advice. I think he's out of town this week (perfect timing!) but if not, then I'm going to call as soon as we get our RFE (and confirm that it's the same issue) and see what he says. I'll let you know what I find out.

I don't think there's any harm in sending the tax transcript and then if they send another RFE, you'll have the verification of non-filing by the time you get it. If it doesn't work, then you'll be ready to go when the you get the RFE so it doesn't seem like it could hurt. But I'm not sure!

Funny, I just graduated from law school (and took several immigration related classes) and I still find the process confusing.

There seems to be a vast number of RFEs regarding tax returns... All the best to fixing these issues. Remember u can also submit Tax transcripts that erases the need for W-2s...
