I came here as F1. I started the adjustment process early 2009. went for the interview in june. everything turned out to be a nightmare when we were separated. we had different answers to some questions. The marriage is real but we had our differences prior to that day and i believe he wanted to sabotage me. i have not heard anything further from them. I have gone through the forums but i cannot find anything close to wat i went through.

If anybody knows how to go about such a case please help.

By He, I am assuming you are referring to your Husband. If he is trying to sabotage your case, then you boarded a sinking ship to begin with. You whole case is based on a marriage based application that banks on legitimacy. If your other half is out to get you denied, then nobody here can help you.

Not sure I could say it any better than that. In order to adjust based on marriage to a USC you need to have a marriage that is actually bona fide or legitimate. If you don't have that, you don't have a basis for adjustment. What were you told at the end of the interview?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The marriage is legit and yah, I know how bad things are but I just wondered if someone had gone through the same ordeal and wat to do next.

They only said that they wud review it and contact us by mail.

Did you guys sit down and review the questions and answers togeter to see the differences? Also, are you sure that your argument is the cause of this? It does not make sense that a simple disagreement before the interview would change him into thrashing your efforts. It has to be something else or a progression of fights.

I think they need an infopass. Its been a while since they had their interview with no response since then.

Hi trillium13! How are you? Yes, So far everything is fine. Until its time to file for removal of conditions. Thats when you'll see me panicking again:). For now, my daughter is keeping me busy, now that she has starting crawling. Seems like all our friends in our batch cleared through with USCIS. What are you upto?

Has anyone in this forum experienced a marriage-gone-bad that fouled up the AOS proceedings? Absolutely. It happens. What to do? Don't wait 10+ months to resolve it!

You mentioned a separation prior to the AOS interview? Meaning? That you were not living with your husband prior?

As it has been said, the AOS fundamentally hinges on clear substantiating evidence proving that a stable bona fide marriage exists between the USC and FN. In other words, to avoid arranged marriages which were simply fueled by the desire of the FN to become a permanent resident.

If you two were separated prior to the interview, he maliciously attempted to sabotage the result, and then (presumably) you two did not resume living in the same domicile, it seems the easy answer is that your petition for AOS has ground to a halt. You are missing the most important factor -- the relationship.

This seems entirely too sensible, but what does he say about all of this?

No VJ member or Immigration Attorney or Congressional Staffer is going to be able to resolve your problem, which exists between you and your husband. If that cannot be rectified, it appears you may need to evaluate your F-1 status and go from there. How much longer do you have left in school?

With that all being said, even without knowing whom is at fault I'm sorry to hear of it. The most well-intentioned relationship can go wrong.

You clearly misread the OP's post, she said "went for the interview in june. everything turned out to be a nightmare when we were separated". She said nothing about them not living together or being separated, only referring to them going to separate room for the interview. Please read and answer with caution.

Make an infopass appointment asap and check on your case status. Do not wait another few months to do it. BTW, did your husband tell you why he tried to sabotage your interview and possibly your future in the US and your marriage? Its not a joke or a way to get back at your wife for any argument you both might have had. Makes me wonder what else he can do to hurt you. Wondering just because it seems very strange behaviour. Hope you can resolve this mess.

What prompted them to seperate the two of you at the interview? What questions did you guys get wrong? Are you guys still living together?

If there is an inconsistency or misrepresentation in the AOS application itself, then I wouldnt blame the interview to be the cause of this delay.

As suggested earlier, make an INFOpass appt and call up your congressional representative for an inquiry.

What's the current status of yourself and your partner? Living together/separated?

Definitely schedule infopass if it's been over a year since you heard anything. You don't want to be sitting in immigration limbo forever, not even knowing if your status is legal here.
