Another thing about the k3 when it was a valid visa. You had to have an unapproved I 130 in process to file for a K3. You no longer have an unapproved I 130 so even if there was still a K3 you can't file for it.

This will not be over quickly. You will not enjoy this.

Would my wife be able to apply for a B2?

'able to apply' ? Absolutely !!!

Would it be granted? Hard to say, with the current background.

But ya know what? It's worth paying the application fee, to find out.

It seems that it will be almost impossible for us to change the heartless Ciudad Juarez consulate's denial for my wife's immigrant visa for false claim to US citizenship.

If she applies for a non-immigrant visa, assuming there are no other issues with that, such as proving that she will not overstay the visa, will the 601 waiver work for the B2 or K3 non-immigrant visa to pardon this false claim to US citizen 212(a)(6)©(ii)?

I don't see it as being heartless at all. You lie, thinking you are going to pull the wool over the eyes of the government then you can reap the consequences.

Even if she were able somehow to get a nonimmigrant visa, she would never be approved for an adjustment of status. She must meet all the admissibilty criteria for an immigrant visa to adjust status. Her inadmissibility for the immigrant visa would make the status adjustment impossible.
