My fiancée (from Canada) and I (from the States) filled for the K1 Fiancee Visa….

On Nov 18th, 2009: the USCIS received our application, proof of the relationship etc.

On Nov 20 (something), 2009: I received the I-797C (NOA) saying that got our check and the app is in process.

On March 2, 2010: the application was approved & on USCIS site is says approved / post activity decision.

March 6, 2010: I received the I-797 (NOA) saying that the app was approved and that we have from 3/2/10 -7/2/10 to get married.

…So this leaves us a little confused. She hasn't been told about any interview or medical dates….Is she allowed to move into the States now?

Any help would be great, Thanks!

The petition was approved, not the visa. She has to apply for the visa.

The USCIS will send the approved petition to the NVC for review then the NVC will transfer the case to the U.S. Embassy in Canada. I think it's either in Montreal or in Vancouver. Your fiancee will have to apply for the visa.

nope! means that just the petition was approved (NOA2), you still have work to do to get the interview and get the visa.

The notice doesn't say you have until that date to get married. That's the petition expiration date, before which the visa needs to be issued. She now will be invited to apply for a visa, get a medical and an interview. Once she has the visa, she can use it one time sometime in the six months following its issue. Once she enters the USA, you have 90 days in which to get married.

For other readers, this kind of confusion is why you see me continually asking people to stop calling a petition a visa application. This is the kind of confusion it causes.

You should be contacted by the US Embassy or Consulate where the fiance(e) will interview. They will either mail her instructions in the form of Packet 3 or directly email the instructions to you or the fiance(e). I have read posts where the instructions were emailed to the USC, so it can go either way.

If you want to get a jump start on things, go to the web site for the Embassy or Consulate (I guess Montreal or Vancouver) and look for their section on Visas. Go to K-1 fiancee visas and locate instructions for appointments and forms, medical, police certifcate and further instructions. You and your fiance(e) will need to be very busy.

Is she interviewing at Vancouver or Montreal?

She needs to fill out all the forms from now on. You petitioned for her eligibility to apply for a visa. She's the one applying for the visa, you are sponsoring her.

You need to send through all the supporting documents as detailed in the K1 guide :guides:

She's the one applying for a visa. Who fills out the form isn't important. The information in the form is about her and it will bear her signature. There's more to the instructions than the DS230. Download them from the Consulate's website and follow them.

She lives in Ottawa, so we're hoping that it will be Montreal. I'm sure I sound like a total moron but to me, this is all confusing. The Sponsor forms are confusing. What to do is confusing. The DS-230 is confusing. Maybe I should stop complaining! I think what I'm more worried about is messing something up.

The process may seem confusing and overwhelming at first, but if you want to do this yourself, the way you combat that confusion is by educating yourself. There is simply too much information for us to address each question one by one for each forums user. That would require a lot of duplication of effort, AND will be of lower quality in general, because something might be missed if you take such a piecemeal approach. You need to get on track to understanding the whole of the process remaining in front of you. Luckily, you've found VJ, and a lot of that information has been gathered for you here! I would also caution you against relying solely on the forums as none of us are lawyers. We are just people like you, who have gone through the process once (mostly), and if you're really afraid of doing something wrong, "Some guy on the intarwebs told me" isn't going to hold up much. Know as much as you can on your own first. :)

I'd like to point you to some resources which may help you to sort out the visa application process. There are a number of links at the top of every Visa Journey page. You've found the forums link, obviously, but there are some others which will help you. These are tried and tested through several cases.

Embassy Info - Once you sort out which Canadian Embassy you're going through (see wiki page below), it has listings of what other users have been asked for and links and all sorts of good information, including what you need for packet 3.

Reviews: Embassy/USCIS-POE - This link will let you read about other users' experiences during their interview at your embassy. They are a good mine for information, and can really help put your fiancee's mind at ease because she'll know what she's in for on interview day.

Example forms: Once you know which forms you need to fill out, there are some confusing fields on these things, because they are multi-purpose forms, some fields don't seem to apply to us. Check how your fiancee is answering against the example forms if you have any issues. If you still can't sort it out, then the forums would be a second choice. (No waiting for a response if you go to the example forms yourself). Plus, if the answer is in there you'll just be directed there anyway.

As if that wasn't enough information, I would also encourage you to take a time out and take a far sighted view of the process. For example, did you know that after the K-1 is all over with, you'll need to adjust her status after marriage for an additional $1010? Knowing what's ahead and what the headaches are there may help you prepare through the next process better (ie better preparation for medical headaches if you get her vaccines before the visa medical, and obtain a copy of the full visa medical before arriving in the US).
