Hey everyone, my fiance has filed for the K-1. We've received our NOA1 today...... I believe we're pregnant. But since we aren't sure how long the process will take and we know a baby takes 9months............. what happens if we get married (since our parents beliefs) while we're applying for the K1 .....??

also...what happens if i have the baby before I get my visa to go to the US?

well since we've already applied and paid for the K1 ....we can't get that back.....is there not a way we can change what we're filing for ?! and not loose the payment or pay even more for another form!!?

No, there isn't any changing once you've started. If you marry, then the K1 is dead and you would then apply for the CR1 (better choice) or K3 and pay the appropriate fee.

If the child is born prior to coming to the US then you would report the birth at the embassy/consulate to obtain the baby's US passport.

Also household size would increase by one. That would increase the income requirements for the affidavit of support from the US citizen petitioner.

Like everyone else said, there is no way to switch your visa without losing your fee and your place in line. You would have to start all over again. Please note that Montreal is a slower consulat than most but look at 6 - 8 months for a K-1 and slightly longer for the spousal visa. Since you've already applied for the K-1, stick with that

To stop and get married now, wait for your marriage certificate, then refile for a CR-1, you're probably looking at over a year before being interviewed in Montreal. I'd just stick with the K-1. I don't know what you mean about your parent's beliefs? Because you're pregnant they believe you should be married now? Sorry, I don't understand....

If you have the baby before you get your visa, then you'll have your baby in Canada. Probably preferable anyway since it won't cost you any money which it surely would in the U.S.!

Pregnancy or having a baby has no affect on the process. If the baby is fathered or mothered by a USC, the child is eligible to be a USC on its own and that filing can happen at the Embassy. I don't understand how both of you can be pregnant but congrats on the future two-some or more!!!

If you marry, then you first have to withdraw the K-1 and then wait and then file CR-1.

LOL....no he's not pregnant!!! I'm speaking on his behalf for the both of us when I said "we" .....

Tell your parents you (were/ are) already engaged and the papers are processing. Tell them it would take more time and more money to change the filing now for the sake of appearances only. They should understand.

I agree.

And don't think just cause you're pregnant pushes you to the front of the line, speeds up anything, or even means you can show any less proofs. Proceed just as you were before.
