mrs Wife. IRS can give you copies of the transcript the same day if you go to their office and request it. Not sure if your husband is in US or Brazil. If IRS is taking time to mail it to you this is an option.

I got 3 years of transcript from my local IRS office. I later got it in my mail too.

I didn't know that! 'Unfortunately' hubby is in BR. What I was thinking is to do the same as Melody. She called them and had the lady in the IRS office sent her by fax. So this is another option.... Maybe I'll wait until the end the week, if we don't receive it, then ask them to fax or something.

Thanks for letting me know, though. I really appreciate it (F)

Thats a bummer. Is the co-sponser just paranoid or what? its not like they have to come out of pocket for anything. Poo on that. Ill cross my fingers for you. Im sure the immigration lawyer will calm him down some. Its not like hes cosigning for a car loan or anything. LOL

From a USC, if you've read the co-sponsor paperwork, it is actually pretty intense. I know the chances of the Government following through in the event of problems are slim, but it is still a legal and binding document. Some of the ramifications are huge for the sponsors. MrsWife, you guys are 10,000% trustworthy, but I have to give a teeny teeny tiny defense to the FIL being a bit leery. I read the papers, and decided I didn't want to ask anyone to co-sponsor, I rushed my 09 taxes and met the poverty limits on my own(which I still think you do on your own as well). I feel SO BAD for your crappy last-minute surprise situation with your FIL and I bet your more insulted personally than anything : ( He knows YOU, It sounds like it's not at all personal, especially if he is speaking with a lawyer. I think he is just intimidated by the scope of that contract- as was I.

As you say, he needs to JUST DECIDE so you and your husband can move forward. Best of luck, I really do think you guys will be accepted on your own. : ) : )

No, I havent read. And you are right, a legal binding document regardless. So, is it more than just support? would a USC be responsible for any criminal activity a beneficiary may commit?

Good afternoon, everyone! Cases are still giving us all ulcers, yes? No worries. Case complete and interview dates are coming very soon.

Here's what I have so far for the AOS Package:

Cover Letter

I-864

2009 Return with W2s

2008 Transcript

2007 Transcript

Paystubs since July 2009

Letter of Employment

Bank Statement

I-864 - Co-Sponsor

I-864A - Co-Sponsor's Hubby

2009 Return and W2s from Co-Sponsor and Hubby

Since our co-sponsor makes plenty above the poverty guidelines, we can just go with the 2009 return, right?

And for the IV Package:

Cover Letter

DS-230

Passport

Birth Certificate

2 Passport-Type Pictures of Hubby

2 Passport-Type Pictures of Myself

Name Change Certificate

FIL's Name Change Certificate (current name not in line with name on hubby's birth certificate)

Marriage License

MIL's Affidavit re: my relationship with her son

Hubby's Affidavit re: our relationship

Divorce Decree from previous marriage

PCC Thailand

PCC Study Abroad for a year

What else should be included? I want to be done with NVC by Spring Break so I can enjoy it with my son.

looks good  but guys do not send NVC anything they did not ask for (trust me it can cause a nightmare  ) this will cause delays and you don't want to try too hard save all the info on your relationship for the interview because thats the only time it may be needed  don't forget you have already submitted enough proof of your relationship to USCIS in order to get to the NVC stage in other words if more proof was needed USCIS would have sent you a RFE so just keep it simple and you will have a smooth NVC journey

My wife is about to email the DS-3032, currently she has the completed signed form attached to the email and has included the form letter (from the wiki) in the body of the email. Is this okay to do? Or should the body of the email just say "please find attached the completed and signed Choice of Address and Agent form."?

Please advise.

Thanks.

As you say, he needs to JUST DECIDE so you and your husband can move forward. Best of luck, I really do think you guys will be accepted on your own. : ) : )

You are right! I agree with you. He is afraid that since when we get back to the US I won't have insurance, if I need medical care and use medicaid he might be enforced to pay it if we don't.

Unfortunately I have to admit that I did take it personal and feel very offended. But since it's the government who would sue them, I understand he needs to make sure what he is about to do.

I also told him that I'll write a notarized letter saying that I will never use the affidavit to sue him or go after money. I don't know if it will be a legal document or not, but either way I just want to make sure they don't think anything wrong about me.

So, he called us and said he talked to the immigration attorney and he explained him how everything works (we did too, but he wanted legal advice). So the lawyer told him that there is no way we will know if our assets and tax returns will be enough before the interview.

He advised him that he could send us the affidavit and we could take with us to the interview, in case the consul asks for a back up co-sponsor we would just hand the papers right there.

(Actually Sachi also told us to do this way, and I really appreciate. Seems that this is the way people do).

That's the path we will follow now. We will send the papers in on our own and if the CO asks for a co-sponsor we will have at the interview. (I really hope not having to use his documents. I can't even imagine if something happens to me the government going after him OMG!)

We did file hubby's tax returns for 09 and it's ready to go. Just waiting for the transcripts for 08,07. FIL said he got his today, so hubby's should be arriving tomorrow, since it was requested on the same day.

Do you guys think we can make on our own? For the returns the numbers are:

2009 - $23,570

2008 - $41,652

2007 - $16,053

Also 5x the poverty guidelines for assets.

Hope that's enough!!! Ahhhhh so nervous about the interview now!!!!!!!!!!!!!

Thank you all for the support! I love this thread and people on it! Thanks a lot guys!!!!!!!!!!!!!!!!!!!!!!!!

The 125% is 18k and some change, but since you have the assets, there is really nothing to worry about... You should be fine without the co-sponsor...

Just noticed something today when i was completing the AOS package. The shipping adress for the AOS package on the coversheet is:

National Visa Center

Attn. CMR AOS

32 Rochester Avenue

Portsmouth, NH 03801-2909

On the cover sheet template for the I-864 is:

National Visa Center

ATTN: CMR

31 Rochester Ave. Suite 100

Portsmouth, NH 03801-2914

So i changed my template to match the adress on the AOS cover sheet that NVC send when we paid our AOS fee. Those that send in their AOS package already, what address did you shipped them to? I'm worry that i'm shipping my AOS package tot he wrong location.

Thanks.
