We're not engaged yet but planning on being in the next couple months.... I'm wanting to move there asap is this possible to do before we get engaged? Or what's the best way to go about it?

I suggest you come down on E-2 visa, stay here for a year, get engaged, live together.

Then at some point, get married in USA, then HE move to Canada with you, get a job in Canada.

No other USA immigration required.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Yea- i did leave that out...... if you plan to engage, Moly, make sure you either refer to your SO as your fiance, or just use his name instead.

Of course, i dont really know much about how much scrutiny the consulate in canada will give you..... I just know it would be a godsend if the guangzhou consulate were as lax as canada's. [not to say that in canada its easy- mind you, i just know GUZ is one of (aside from mid-eastern consulates) the hardest to get through.]

I don't know, from what I read, Equador is a real b1tch to get through...

You could stay in America for the duration of your Visa Waiver, which is 6 months, and then return to Canada and file a K3 marriage visa. You could not work in the US during that time, and this process would not be faster than getting a fiance visa. If you just stayed in the US, you would be there illegally and thus would have trouble finding work or returning to the US if you ever left.

Just so we don't confuse terms, Canadians dont' travel on the Visa Waiver and the duration of stay is up to the Border Patrol at the time of entrance. And no, you cannot move and work right after marriage. If you wish to move with your husband after marriage, then you'll need to apply for the appropriate visa. You can go fo the K-1 visa, which is for someone who is engaged, or you can go for the Cr-1 (better than the K-3)

Going to the US with the intentions of marrying and staying, while traveling as a tourist, is illegal and can result in a lifetime ban from the US.

Hi Moly,

If you're thinking of becoming engaged, and want to move to the U.S., then you have to petition for a visa. Either a fiance's visa which is a K-1, or a marriage based visa (after you're married you'd apply) probably a CR-1 visa. Please read the Guides to see which one is best for you.

When you're engaged, and if you're applying for a K-1 visa, then you can still visit until you are granted the visa to move here as long as you can provide proof of sufficient ties to Canada.

I'm a canadian girl who's been dating an american for 8 months now. Our plan is to get engaged within 4-5 months and marry by the end of the year. I'm wanting to move to the US and work before we get married. Is this possible to do? What do i have to do to work and live in the US before marrrying. Please help this is so frustrating...

Those numbers can be misleading. They represent the ratings people give a consulate, and not the visa approval rate. They have more to do with someone's experience dealing with the consulate than anything else. Some people will feel they were severely mistreated by the consulate staff, and give a correspondingly low rating, but they might still have had their visa approved. The embassy in Hanoi is rated almost the same as GUZ, yet Hanoi doesn't even issue visas.

That said, GUZ is known on this board to be a tough consulate to get a visa from. I think it's a safe bet that it's a lot tougher than Montreal or Vancouver.

It's not illegal for a foreigner to come to the US and marry a US citizen. Also, the spouse of a US citizen is generally permitted to adjust status without leaving the US, provided they entered the US legally (barring certain types of restricted visas). What is not permitted is to enter the US using a non-immigrant entry privilege with the intent of immigrating. That would be fraud. The burden would be on you to prove to USCIS that you did not intend to immigrate when you entered; i.e., to marry and apply for a green card. Some attornies claim that getting married within a certain time frame will trigger an automatic presumption of fraud by USCIS (some say 30 days, others say 60 days). The bottom line is that USCIS might deny your AOS petition, and you might be banned from the US for presumptive immigration fraud. This is definitely the fastest way to immigrate to the US, but it carries a very severe penalty if you fail. It's far less risky to apply for and obtain the appropriate visa.

Not to make light of the GUZ challenges at all, but the Ecuador ratings are skewed mightily toward a deceptively positive-seeming conclusion. I know of FIVE couples here on VJ who have NOT submitted reviews and who would rate Guayaquil (Ecuador) a Zero -- and only because there is no lower rating.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
