We're in the middle of our K1 paperwork, and currently looking at the 1-134. We're wondering if we should use the 1040s or the W2s? We have the option of either printing the 1040 from the computer at IRS' own web page, or we can order copies of them, with the government seal, for 57 dollars a piece or only order the W2s - which will take aprox 40 days to receive from the IRS. Can anyone here please offer some advice as far as what option we should use? Will it be okay just to print ut the 1040s from the computer, along with an employment letter?

I guess my first post was a poor explanation. What I am asking here is whether we should use the 1040 or the W2? It takes about 10 days to get the 1040's, while on the other hand it says it'll take 45 days for the W2s. Can we submit the 1040s with our I-134? We'll save a month or so by getting the 1040 rather than the W2

the tax return is the 1040 not the w-2. u will need the 1040.

OK let me clear this up so we all understand.

The 1040 is the form you file your taxes with the US government, the w-2's are the supporting documents from the employer which go with the 1040 to show how much you were supposed to claim on the 1040 form. If you are going to use the 1040 you need to turn in BOTH the 1040 and the W-2.

OR EVEN BETTER since you know how to order these forms from the IRS go the EASIER route and ORDER THE TAX TRANSCRIPTS...these documents are FREE and take about 5-10 days to get and you will not need any supporting documents, meaning you don't have to get the w-2's.

To get them you call the 18008291040 # for the IRS and follow the prompts.

What?

You can get tax transcritps FREE. DO NOT pay anyone $57 for them. If you have a fax machine they will fax them to you immediately FREE. You do not need any government seal, whatever that is. You can use a copy of your tax return WITH attached copies of w-2s. If you get FREE transcripts you do not need the w-2s.

Thank you for your reply, Gary! I had to stop my fiancè from ordering and paying for the copies yesterday. I know he's thinking any amount of money is worth it to have us together, if that's what it came down to. Luckily we know better now, and he will call them up first thing monday morning for our FREE transcripts! Once again, I am SO happy we found VJ, we'd be lost without you guys!

Call the IRS toll free number (1-800-829-1040) and order your last 3 years tax TRANSCRIPTS. Takes maybe 1 week at most and is 100% free. Send these (after making a few backup copies) with your I-134 along with your W-2's. My company pay is all internet based so it was easy for me to just go online and copy my last 3 years W-2's. Here is a list of what I sent in to the embassy in July 09 for my Fiancee's interview. We passed easily.

Letter of employment on company letterhead. Include salary, status etc.

3 years tax transcripts with W-2's

4 or 5 of my latest pay stubs

Copy of my latest bank statement. I since learned this is not really needed.

My income was well above the poverty line so I did not include any asset data like property values etc.

If your income exceeds 125% of the poverty line when counting yourself, prospective immigrant and any

dependents, then don't bother with assets (401K, Stocks/bonds etc..), it is just extra unneeded

data to provide, the consular officer is most concerned with INCOME.

So obviously the OP's fiancee works for herself? Because you need a letter from your bank stating how much has gone into your account, how long you've had the account etc... you only need the tax return if you work for yourself. Otherwise you need a letter from your employer stating how much you earn.

So obviously the OP's fiancee works for herself? Because you need a letter from your bank stating how much has gone into your account, how long you've had the account etc... you only need the tax return if you work for yourself. Otherwise you need a letter from your employer stating how much you earn.

Kindly spare the OP incorrect information.

Bank letters are optional (but actually more benficial for self employed people) Employment letters are optional. In fact the whole damn thing, I-134 and all IS OPTIONAL. The I-134 is nothing but a pre-printed covder letter for the documentation you attach behind it. It is not required.

What IS required is that you staisfy the consulate that you can support your fiance(e) and they will not become a public charge. An I-134, tax transcripts indicating sufficient income and maybe something more recent (a few current check stubs) is ALL you need. For that matter you do noeed to have made enough LAST year to qualify THIS year. He could have made $743.26 LAST year anbd THIS year has a job paying $34,000 per year and he would qualify!

Not many consulates will let you get away with not presenting a tax return. Even Kiev, an easy consulate, which specifically gives you the option of presenting 2 of 4 items, including a tax return, will routinely refuse to issue visas if one of those items is not the most recent year's tax return. I have witnessed it myself. There is no way I would feel comfortable going to an interview anywhere without last year's tax return.

There are couple of nebulous steps in this process. This is one of them. It is a consulate judegement call. There is no "finish line" there is nothing cut and dried...pass/fail. It is a subjective judgement call and there is no way I am taking anything off the table. FWIW I presented at two interviews (K1/K2 and K2 to follow) ONE tax return, bank letter, employment letter AND a copy of ALL check stubs for the current year at the time of the interview.
